RESOLUTION OF 'nlE COUNCIL OF THE CITY OF ?ALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LAND AT
170 LOWELL AVENUE AND GRANTING EXCEPTIONS
WHEREAS, 15,000 square feet of property zoned R-1 and located
at 170 Lowell Avenue in the City of Palo Alto, hereinafter referred
to as the t!Subject Property" is proposed to be divided into two (2)
lots; and
WHEREAS, lots in an R-1 (Single-Family Residence District Regula-
tions) zone district are required by Section 21.20.110 of the Palo
Alto Municipal Code to have a uidth of 60 feet and an area of 6000
square feet and one of the proposed lots fails to have this width
and area.; and
WHEREAS, the proposed division ot land requires exceptions from
said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE
as follows~
SECTION l. The City Council finds that there are s9ecial condi-
tions affacting the lots, including the fact that the location of the
existing house dictated where the new prop~rty line must be drawn
and the exceptions granted herein are necessary for the preservation
and enjoyment of a substantial property right of the petitioner,
and that the exceptions granted herein will not be detrimental to the
public welfare or injurious to other property in the territory in
wbicb this property ~.s situated since the width and area are the same
as the width and area of other parcels in the same vicinity.
SECTION 2. The City Council hereby approves the Miscellaneous
Divi'siun of Land for the subject property, as shown on the map
attached hereto and incorporated herein by reference, and grants the
exception to the 60 foot width and 6000 square foot ar~a require-
ments as provided in Chapt3r 21.28 of the Palo Alto Municipal Code,
with the conditions that:
1. The room straddling the new property line and the existing
~wo-car garage be removed;
2. A covered parking space be provided on Lot 1, and
3. Mo building or pavin3 be allowed within a 10-foot radius
of tbe 30-incb and 20-inch redwoods and the fir tree at
tbe front of Lot 2.
SBCTIOR 3. The City Council bereby finds that the proposed project
will not have a significant impact on the environment.

RESOLUTION NO. 5720
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 1501 OF THE MERIT SYSTEM RULES AND
REGULATIONS RE MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF PALO ALTO AND LOCAL 1319, INTERNATIONAL
ASSOCIATION OF FIRE FIGHTERS
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. Section 1501 of Chapter 15 of the Merit System
Rules and Regulations hereby is amended to read as follows:
"1501. Memorandum of understanding incorporated
by reference. Thac certain memorandum o~under
standlng dated July 19, 1979, by and between the
City of Palo Alto and Local 1319, International
Association of Fire Fighters, consiating of
Article I through VIII and numbered pages one
through four for a term cotnmencing October 1,
1978, and expiring December 31, 1979, hereby is
incorporated into thes~ Merit System Rules and
Regulations by reference as though fully set
forth he4ein. Said memorandum shall apply to all
employees in classifications represented by said
Local 1319, Ir~ternational Association of Fire
Fighters, except where specifically provided
otherwise herein.
"In th~ case of conflict between this chapter
and any other provisions of the Merit System
Rules and Regulations, this chapter will prevail
over such other provisions as to employees
represented by said Local 1319, International
Association of Fire Fighters."
SECTION 2. The changes provided for in this resolution shall
not affect any right established or accrued or any offense or act
committed, or any penalty of forfeiture incurred, or any prosecu-
tion. suit, or proceeding pending or any judgment rendered prior
to the effective date of this resolution.
SECTION 3. The Council finds that the enactment of this
resolution is not a project under the California Environmental
Quality Act and, ther~fore, no environmental i.mpact assessment is
necessary.
