' • ORIGINAL RESOLUTION N0.5 ;;;..;;n~s ___ _ RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING THE MISCELLANEOUS DIVISION OF LAND AT 1830 COWPER/458 TENNYSON AND GRANTING AN EXCEPTION WHEREAS, 25,000 square feet of property zoned R-1 and located at 1830 Cowper and 458 Tennyson in the City of Palo Alto, hereinafter referred to a.s the "Subject Property" is proposed to bf> redivided into two (2) lots; and WHEREAS, lots in an R-1 (Single-Family) Residence District Regulations zone district are required by Section 21.20.110 of the Palo Alto Municipal Code to have a width of 60 feet and one of the propcsed lots fails to have this width; and WHEREAS, the proposed division of land requires an exception from said re~uirements. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that there. are speci.al condi- tions affecting the lots, including the fact that Parcel 2 is currently substandard in width and its width will not be altered by this lot division and that the exception granted herein is necessary for the preservation and enjoyment of a substantial property right of the petitioner, and that the exception granted herein will not be detri- mental to the public welfare or injurious to otbe1 property in the te~ritory in which this property is situated. SECTION 2. The City Council hereby approves the Miscellaneous Division of Land for the subject property, as shown on the map attached hereto and incorporated herein by reference, and grants the exception to the 60 foot width requirement as provided in Chapter 21.28 of the Palo Alto Municipal Code, with the condition that the lath stT-~cture be removed. SECTION 3. The City Council hereby finds that the proposed p_roject will not have a significant impact on the environment. INTRODUCED AND PASSED: July .23, 1979 .
