RESOLUTION NO. 5705
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
STATING ITS INTENTION TO DISCONTINUE THE USE OF A
PORTION OF EL CAMINO PARK AND TO SUBMIT THE QUESTION
OF DISCONTINUANCE TO THE CITY OF PALO ALTO ELECTORATE
WHEREAS, Article VIII of the City of Palo Alto Charter, in conjunc-
tion with the provisions of California Government Code Sections 38440
et. seq., authorizes the City Council to discontinue dedicated park land
use by submitting the que.~tion of such discontinuance to the electorate;
and
WB.EREAS, the City Council is currently considering a proposal to
develop a portion of the dedicated El Camino Park with restaurant
facilities and meeting facilities for nonprofit organizations;
NOW, THEREFORE, the Council of the City of ?alo Alto does RESOLVE
as follows:
SECTION 1. The public interest and convenience require that a por-
t:!.on of the park cc. .. nnonly c&:;.led El Camino Park be discontinued as a
dedicated park; the question of such discontinuance is inteHded to be
submitted to the City of Palo Alto electorate. The City Council is con-
sidering development of said portion of El Camino Park for (1) restaurant
purposes, (2) meeting rooms for the veterans and other nonprofit groups
such as the Junior Chamber of Commerce, and (3) office purposes inci-
dental to the uses specified in numbers (1) and (2).
SECTION 2. The portion of El Camino Park which is to be discontinued
fer park use-is described in Exhibit ''A11 attached hereto and incorporated
herein by reference.
SECTION 3. The public or persons particularly· interested may pro-
test such intended discontinuance of a portion of El Camino Park at a
public hearing on August 6, 1979, at the City Council Chambers, 250
Hamilton Avenue, Palo Alto, California, at 7:30 p.m. or as soon there-
afte~ as the matter may be heard.
SECTION 4. The City Clerk is directed to cause this resolution to
be published twice i.n .... daily newspaper published and circulated in the
City of Palo Alto at leas~ twen.ty days before the time set for hearing.
SECTION 5. Th~ City Manager or his designee shall cause at least
three notic~s of the adoption of this resolution ~o be posted con~picu
ously not more than three hundred feet apart along the exterior boundaries
of the area proposed to be discontinued as a public park. Posting shall
be completed at l~ast twe~ty days before the time set for hearing.

SECTION 6. The Council finds that this project will have no
~igniflc&nt adVerse environmental impact.

COMHEUCIUG at the intersection of the southwesterly line of the
Southern Pacific Railroad Comr q,ny' s right-of-way, 230 fe~t in
width, (as described in that \,.;<!rtai.n easement of Leland Stanford
to the Southern Pacific Railroad Company, dated Uovember 23, 1892,
and recorded October 23, 1915, in Volume 435 of Deeds at page 244,
Santa Clara County Records, in which the bearing of said line is
called north 51° 23' \lest, which line is also the southwesterly
line of that certain easement (Palo Alto Agreement No. 224) granr~d
by the Southern Pacific Railroad Company to the City of Palo Alto
by Agreement dated October 2, 1939, and recorded November 27, 1939,
in Book 954 of Official Records, page 567, Santa Clara County
Records), with the center line of University Avenue produced south-
westerly, as s&id University Avenue exists 75 feet in width (said
intersection being the most easterly po~nt of Parcel 1 as described
in that certain lease of the Board of Trustees of Leland Stanford
Junior University to the City of Palo Alto (Palo Alto I.ease No. 3)
dated JW1~ 10~ 1915, and :r-ecorded by Stanfo-:d University on
September 23, 1915, in Vol P of Le~ses at page 333 et seq., Santa
Clara County Records, in which the beaxing of said line is called
North 51° 45' West); thence Nor~h 51° 41' 59" West along said
southwesterly line a distance of 467.50 feet to the intersection
of said liue of rieht-of-way with the center line of Lytton Avenue
(prolonged); thence Sm.ith 38° 58' 01" West along said center line
of Lytton Avenu~ (prolonged), a distance of 81.00 feet to a point
on the southwesterlymost line of Parcel Ho. 2, City of Palo Alto.
