RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE M1SCELLANEOUS DIVISION OF LAND AT
450-452 MARION AVENUE AND GRANTIL-lG EXCEPTIONS WITH
CONDITIONS
WHEREAS, 16,444+ square feet of property zoned R-1 and located at
450-452 Marion Avenue in the City of Palo Alto, hereinafter referred
to as the "subject property" is proposed t'j be divided into two lots;
and
WHEREAS, lots in an R-1 (Single-Fa~ily Residence District Regula-
tions) zone district are required by Section 21.32.050 of the Palo
Alto Municipal Code to have frcntage on a public street, and access
to a rear lot shall be over land in the same ow-nership as the rear
lot; and by Section 21.30.110 to have a depth of not less than 100
feet; and
WHEREAS, the proposed rear lot would have access over an easement
and would be less than 100 feet in depth.
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE
as follows:
SECTION 1. The City Council finds that there are special condi-
tions affecting the subject property; that the exceptioPs are necessary
for the preservation and e~joyrnent of 1 substantial property right of
the petitioner; and that the granting of the exception will not be detri-
mental to the public welfare or injurious to other property in the ter-
ritory in which the subject property is situated.
The Council further finds that the project, includin~ design and
improvements, is consistent with th~ ~dopted Comprehensive Plan; that
the site is physically suitable for the type and density of the proposed
development; that the project is not likely to result in serious health
problems, and that there are no conflicts with public easements.
SECTION 2. The City Council hereby approves the Miscellaneous Div~.sion of Land for the subject property, as shown on the map attached
hereto and incorporated herein by reference, and grants the exception to.
the requirement that access to a rear lot being over land in the same
ownership as the rear lot and to the depth r~quirement as provided in
Section 21.28 of the Palo Alto Municipal Code, with the following condi-
tions:

An easement shall be executed to the satisfacti~n of the City
Attorney, City Engineer, and Fire Chief granting common right
of access to all four interior lots -over the entire f1proposed
turnaround" area, and common access to Parcel 1 and Parcel 2
over an easement not to exceed 12 feet in width across Parcel l.
A Public Utilities Easement shall be dedicated across Parcel
1 to Parcel 2 for all utility lines.
Public Utilities shall be extended at the cost of ~1e develooer
along this Public Utilities Easement to the property line of·
Par~el 2, and electric power line$ shall be undergrounded from
the existing power pole to Parcel 2.
SECTION 3. The City Council hereby finds that the proposed project
will not have a significe;t impact on the environment.
