HomeMy WebLinkAboutRESO 5687.. • • ORIGINAL RESOLUTION NO. 5687 ----- RESOLUTION OF THE COUNCIL OF THE CI~"Y OF PALO ALTO APPROVING THE MISCELLANEOUS DIVISION OF LAND AT 471 CHANNING AVENUE AND GRANTING EXCEPTIONS WITH CONDITIONS WHEREAS, 12,500 square feet of property zoned R-2 (Single-Family and duplex development) located at 471 Channing Avenue, here ... nafter referred to as the "subject property" has been proposed to be divided to create two lots; WHEREAS, Section 21.20.110 of the Palo Alto Municipal Code requires that no lot shall be less than sixty (60) feet in width and Section 18.17.0SO(a) states that the minimum site area shall be 6,000 square feet; and WHEREAS, the width and square footage of the subject property re- quire exce~tions fr')Dl said requirP.ments. NOW, THEREFORE, the CQuncil of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that there are special conditions affect!ng the lots: that the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner; a~n, that the granting of the exception will not be detrimental to the pubiic welfare or injurioue to other prop~rty i.n the territory in which the property is situated. The Council further fi"ds that the project, in- cluding design and improvements, is consistent wi~h the adopted Compre- hensive Plan; that the site is physically suita~le for the ~ype and density of the proposed development; that the project is not likely to result in serious health problems; and, that thP.re are no conflicts with puhlic easements. SECTION 2. The City Council hereby approves the miscellaneous divi- sion of land for the sub~ect property as shown on the map attached hereto and incorporated herein by reference, and grants the exception to the 6,000 square foot lot and the required 60 foot frontage requirement at 471 Channing Avenue as provided in Chapter 21.28 of the Palo Alto Munici- pal Code with the following conditions: a. b. c. Lot No. 2 shAll be for a single-family house, and no conversion to a duplex will be permitted; The house cm Lot No. 2 shall meet all site develo?ment regula- tions; and All trees on the site shall be preserved. SECTION 3. The City Council hereby finds that the proposed project wi11 not have a significant impact on the environment.
