RESOLUTION OF TIIE COUNCIL 0F THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LAND AT
810, 820, 830 LOS TRANCOS ROAD AND GRANTING EXCEP-
TIONS WITH CONDITIONS
WHEREAS, 29.6 acres of property zoned 0-S (Open Space District
Regulations) a~d located at 810, 820, and 830 Los Trancos Road in the
City of Palo Alto, hereinafter referred to as the "subject propertyn is
proposed to bt: divided into three (3) s:J.ngle family lots; and
WHEREAS, Section 21.32.050 of the PRlo Alto Municipal Code requires
that all lots created by a subalvision have frontage on a pu~lic street;
Section 21.32.0SO(b) requires rear lo~s to have an acrea exceeding by
twenty (20) percent the lot area requirt:mcnt of the district~ exclusive
of any access to a public street; and Section 21.32.050 requires access
to a rear 1,,t to be C"..?er land under the sarue ownership as the rear lot;
and
WHEREAS, Section lS.71.070 requires a minimum lot size to be ten (10) acres; and
WHERE~S, P~rcels 2 and 3 fail to have the area required by Section
21.32.050(b) and lack access over property under the same ownership as
those lots, and parcel 3 does not have frontage upon a public street.
NOW, THEREFORE, the Council of the City of P1tlo Alto does RESOLVE
as follows:
SECTION 1. The City Council finds that there are special con~itio~s
affecting the locs, including the terrain which is located upon ext%emely
steep land; and that the granting of the exce~~ior.s will not Le detri-
mental to public welfare or injurious to other property in the territory
in which the property is situated; and that the exceptions granted ar~
necessary for the preeerv•tion and enjoyment of a substantial property
right of the petitioner.
The Council further finds that the project, including design and 1m·
provements. is consistent with the adopted Comprehensive Plan; that the
site is physically suitable for the type and densitv of t~e proposed
development; that tha project is not likely to result in serious health
problems; and, that there are no conflicts with public easements.
§ECTION 2. The City Council hereby approves the Miscellaneous
Division of Land tor the subject property. as shown on the map attached
hereto and incorporat~d herein by reference, and grants the excepti?na
that the lots all have frontage on a public street; the requiremen.t that
the rear lots have an area exceeding by twenty (20) percent of the lot
area requirement of the district, exclusive of any access to a purlic
street and the requirement that each lot size be a minimum of ten (10)
acresi and that access be over land under the •ame ownership as the rear
parce a, with the following condicions:
1. Access from Los Trancoa Road must be capable of supporting
?3,000 pounds of fire apparatus during all weather, must
have a 20-foot all-weather •urface. must have a clear 13-
foot overhead clearance, must have an incliue not in excess
of 15 percent, and lDUlt !Deet the V)rtical and horizontal
curves established for fire apparatua.

The road improvements shall be installed ~rior to City
approval of tne parcel map, or an agreement shall be
executed and a bond shall be posted by the subdivider,
in the amc'..ltlt to be determined by the City, prior to
City appro~al of the map, to ensure completion of roa~
improvemc~ts prior to issuance of any building, grading,
electri~a~~ plumbing o~ other permits fur tha develo~
ment of the subject property.
Prior to City approval of the parcel ~ap, the eubdivider
shall execute an agreement, subject to approval by the
City Attorney, for continual maint~nance of the private
accees road in the &ubdivision to the standards required
by the Palo Alto Fire Department. Such agreement shall
be r~corded and shall run with the land.
The owners of all lots shall have nonexclusive right of
ingress and egress along t:le pr"'posed access road, a 40-
foot easement.
The cieveloper shall provide for drainage a1ong the proposed
20-foot road within the subject propertiea subject to the
approval of ~he City Engineer.
Cut and fill slopes shall not exceed two horizontal tc one
vertical. All slopes shall be protected with native plants
to prevent erosion.
Each parcel in the subdivision shall be required to have an
adequate on-site domestic and emergency water supply de-
signed to meet all applicable City codes and specifications.
To this eGd, the subdivider shall either install a six-inch
public water m~in to each lot, g~anting a 20-foot wide pub-
lic utility eaRement to accoannodate this water line, and in-
stall fire hydrants at each lot, or secure County Environ-
men~al Agency approval for instalirng wells at each lot, 2!_,
install a common well with easements to each lo~. The water
aupply must have sufficient capac1ty to satisfy Fire
Department requirements. Design of the water line and place-
ment of hydrants is subject to approval by the City. The
water lin~ and hydrants shall be installed prior to City ap-
proval of the final parcel map or an agreement shall be exe-
cut~d ~nd a bond shall be posted by the subdivider, in the
amount to be determined by the City, prior to City approval
of the final map, to ensure completion of these improvements
prior to issuance of any building, grading, electrical,
plumbing or other permits for the development of the subjec·..:
property.
The developer shall pay all exten1ion charges to each parcel
to Pacific Gas and Electric Company unless PG&E refuses to
serve. Then the developer shall pay extension charges per
City Schedule E-5. Internal subdivision electric ~lnes shall
be undergr«:>und.
The developer shall receive County of Sant1 Clara Health
Department approval of septic systems installations and wells,
prior to approval of finel map.
The developer shall submit to the City of Palo Alto an offer
of dedication. for road purposes, of a strip of land 40 feet
widQ lying equally on each side of the existing centerline.

10. The access road must be flared at Los Trances Road to provide
a alight distance 0 f approximately 200 feet in each direction.
The specific design shall be approved by the Direct~= of
Transportation. The additional access road at norr.h end of
prope·rty shall be -rentoved.
11. No building permits shall be issued until all the above condi-
tions have been met and the final map has bee~ approved and
recorded. Pursuant to Section 21.32.100 of the Palo Alto
Municipal Code conditions shall be fulfilled within 180 days
of Council approval'
SECTION 3. ThP. City ccuncil hereby finds that the proposed project
will not have a significant impact on the environment.
