HomeMy WebLinkAboutRESO 5676• ORIGINAL RESOLUTION NO. 5676 ----- RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING THE TENTATIVE SUB~IVISION MAP FOR THE PROPERTY LOCATED AT 31570 PAGE MILL ROAD IN THE CITY OF PALO ALTO AND GRANTING EXCEPTION AND VARIANCE SUBJECT TO CONDITIONS WHEREAS, approximately nineteen acres of property zoned o-s {Open Space District Regulations) and located at 31570 Page Mill Road in the City of Palo Alto, and identified as Assessor's Parcels Nos. 351- 05-0l4, 351-05-03~ and 351-05-036 hereinafter referred to as the "sub- ject property," is proposed to be divided into two (2) parcels of ap- proximately nine (9) acres and ten (10) acres~ WHEREAS, Parcel A is required by Section 18.71.070 to hava an area of ten (10) acres and fails to have such area; and, ~ . 'WHEREAS, buildings c, D and E shown on the map attached hereto and incorporated herein by this reference are located within the two hundred foot setback along Page Mill Road established pursuant to Sec- tion 20.08.020; and, WHEREAS, in order to preserve the present legal nonconforming residential density of two units per nineteen acres it is necessary that building E and either building c or D be removed from residential use and converted to a conforming use, or in lieu of converting either building C or D all residential development rights associated with Par- cel B must be transferred to Parcel A. NO~~ . THEREFORE, the CQ~.mcil . _of the City of Palo Al to does RESOLVE as follows: SECTION 1. The City Council finds that there are special circum- stances affecting Parcel A, including the shape, location and steepness of the property as it leaves Page Mill Road; the exception and variance requested are necessary for the preservation of a substantial property right of the petitioner; and that the granting of the exception and variance will not be detrimental to the public welfare or injurious to other property in the territory in which it is located. SF.cTION 2. The Council further finds ~hat the project will not have a significant impact on the environment; that the project is con- sistent with the adopted Comprehensive Plan; that the site is physically suitable for the proposed developmentJ that the subdivision is not likely to result in serious public health problems; that there are not conflicts with public easements; · SECTION 3. The City Council hereby approves the tentative map attacKed as Exhibit "A" and grants the exception to Section 18.'ll.070 of the Palo Alto Municipal Code and the variance from the two hundred foot setback for the three existing st.cuctures on Parcel "A" and for Parcel "B" under Section 20.os.020 of the Palo Alto Municipal Code, subject to the following conditions: " , ' ' -•. • • 1) Thirty feet on the northerly and easterly side of the center line of Page Mill Road shall_ be dedicated to the City for street purposes; 2) All property corners shall be surveyed and monumented; 3) Building E and either Building C or Building D shall be removed from residential use and converted to a conforming use, or in lieu of converting either Building c or D applicant shall record such documents as are satisfactory to the City Attorney to transfer residential develop- ment rights of Parcel B to Parcel A; provided, that in the event Buildings C and D are rendered legal conforming uses by reason of a rezoning to P-C (Planned Cominunity Development) or otherwise, then the requirement of converting either Building-C or D or transferring the residential development rights from Parcel B to Parcel A shall no longer be in effect.
