HomeMy WebLinkAboutRESO 5663' .... • ORIGINAL RESOLUTION no . 5663 RESOLUTION OF THE COUUCIL OF THE CITY OF PALO ALTO AMENDiliG CHAPTER 16 TO THE MERIT SYSTEM RULES AND l\EGULA'rIONS TO ADOPT A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PALO ALTO MID THE PALO ALTO PEACE OFFICERS' ASSOCIATIOU WHEREAS, the City of Palo Alto and the Palo Alto Peace Officers' Association have met and conferred in accordance with the require~ ments of the MeyersMlUlias-Brown Act; and WHEREAS, the provisions of SB 154 (1978) effectively prevented negotiations in approximately July 1978, the time when agreement would otherwise have been sought, and such provisions of SB 154 have now been held unconstitutional by the California Supreme Court; The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. Chapter 16 of the Merit System Rules and Regulations is hereby amended to read as follows: "CHAPTER 16 MEMORAHDUM OF UNDERSTANDING PALO ALTO PEACE OFFICERS' ASSOCIATION Sections: 1601 Memorandum of understanding incorporated by reference 1601. Memorandum of \lllderstanding incorporated by reference. That certa!n memorandUI!l of understanding dated March 1979, by and between the City of Palo Alto and the Palo Alto Peace Officers 1 Association is hereby incorporated into these Merit System Rules and Regulations by reference as though fully set forth herein. In case of conflict with this chapter and any other provisions of the Merit System Rules and Regulations, this chapter will prevail over such other provisions as to employees represented by said Palo Alto Peace Officers' Association." - SECTION 2. The changes provided for in this resolution shall not affect any right established or accrued er any offense or act committed, or any penalty of forfeiture incurred, or any prosecution, suit, or proceeding pending or any judgment rendered prior to the effective date of this resolution. SECTION 3. The Council finds that this is not a project under the Califcrnia Environmental Quality Act and, therefore, no environ- mental impact assessment is necessary. This Memorandum of Understanding made and entersd into at Palo Alto, California, by and between the City of Palo 1\lto, a municipal corporation. hereinafter referred to as the CITY and the Palo Alto Peace Officers' Association, Incor- porated, a California corporation, hereinafter referred to as the ASSOCIATION, is i~tended to define agreements reached during the meet and confer process concerning wages, hours, working conditions, and other tenns and conditions of employment for the represented group of enployees. ARTICLE I. RECOGNITION Pursuant to Sections JS00-3510 of the Government Code of the State of California, the Charter of the City c:.f Palo Alto, and the City of Palo Alto Merit System Rules and Reguiations, the City recognizes the A5sociation as the exclusive representative of an employee group consisting solely of Poiice Officers, Police Agents, and Police Sergeants who are regularly employed by the City and others i-lho might be amended into the representation unit from time to time un<l~r existing law and the Merit System Rules and Regulations. ARTICLE If. ARTICLE II I. FULL UNDERST.'~NDING Section 1. The Memorar.dum of Understanding ccntains the full and entire under- standing of the parties regarding the matters set forth herein. Existing prac~ tices and/or benefits which are not referenced in the Memorandwn of Understanding and which are subject to the meet and confer process shall continue without change unless modified subject to the meet and confer process. The City assures the · J\ssociaticn thilt unless chcingcs are warranted bl operational necg~s ity, it does not intend, nor does it anticipate, during the tenn of this Memorandum of Under- standing .any change, modification, or cancellation of wages, hours, and working conditions which are subject to meet and confer and which are presently in effect or contained in this Memorandum. Section 2. It is the intent of the parties that ordimmces. resolutions, rules and regulations enacted pursuant to this Memcraridum of Understanding be adminis·· tered and observed in good faith. Nothing in this agreement shall preclude the parties from mutually agreeing tc meet and.confer on any subject within the scope of representation during the t~rm of this agreement. ARTICLE IV. SALARY PROVISIONS Section 1. ,Effective b~ginnin9 June i8, 1978, a ~alary increase of 7% will be applied to the salary ranges cf the following classifications: POLICE OFFICER, POLICE AGENT, and POLICE -SERGEA:IT. E-Step hourly rr:aximums \·til 1 be as fol lows: Police Offic~r $9 .59 = $1662 approx. Police Agent $10.71 = $1856 approx. Po1ice Sergeant $11.42 = $1979 approx. Section 2. Effective beginning June 30, 1979, a salary increase of 7% will be applied to the salary ra:1gcs of the following classifications: POLICE OFfICERs POLICE AGENT, v.nd POLICE SERGEANT. E-Step h'lurly maximums wil 1 be as follows: Police Officer $10.26 = $1778 approx. Poljce Agent $11.46 = $1986 approx. Pc1ice Sergeant $12.22 = $2118 approx. ARTICLE V. PROBATIONARY PERIOP The probation::iry period for new employees entering the cl3ssification of Police Officer after Marchi, 1979, sh~ll be 12 months following successful completion of Police Academy training. The probationlry period for lateral entry Officers Agents, or Sergeants! lrller·e Police Ar.aciemy training 1s waived, shall be 12 months. ARTICLE VI. RESPONSIBILITY OF THE ASSOClf,TI_ON The Association agrees to present and reco:miend this Memorandum of Understanding to its. membersttiµ for ·tatification as soon as possible, iJ.m.i to ;-eport such rati- fication to ManagemE:nt. _ ARTJCLE VII. DURATION • This Memorandum of Understanding shall become effective July l. 1978 and shall remain in effect until June.30, 1980.
