RESOLUTIOZ~ OF TilE COUNCIL OF THE CITY OF PALO ALTO
ORDERIHG THE VACATIOH OF A PUBLIC UTILITY EASEMENT
(ALTA MESA CEUETERY)
WHEREAS, it is the intention of the Council of the City of Palo
Alto to vacate a public utility easement in the City of Palo Alto,
County of Santa Clara, State of-California as described in Exhibtt "A"
atta~hed hereto and as shown on a map marked Exhibit "B" attached
hereto:·a.nd by ref~rence made a part· hereof; and
WHEREAS, a new underground public utility easement has been
granted to the City to replace said overhead public utility easement;
and
WHEREAS, on January 29 , 1979, the Council of the City of Palo
Alto passed a resofution setting forth the time and place for a
public hearing for all persons interested in the proposea vacation;
and
WHEREAS. from all the evidence·submitted to the Council of
the City of Palo Alto at said hearing it is found that said e&selllents
as described herein are unnecessary for present or prosp~ctive public
utility purposeg~ ·
UOW, THEREFORE. the Council of t~e City of Palo Alto does RESOLVE
as follows:
SECTIOH 1.. That pursuant" .. to·· provisions of Sec t:ion.-50443 of the
Government Code of ·the State of California, the Council of the City
of Palo Alto does hereby order that said easements as described herein
be and hereby are vacated~
SECTIOH 2. The Council heteby·determines that this is not a
project as defined in Section 11. 04.130 of the Pa:to Alto Municipal
·Code· and, therefore, no envi"rormiental impact as-sessment is ·necessary.
SECTIOH 3. The City Clerk shall cause a certified copy of its
resolution to be recorded in the off ice of the County Recorder of Santa
Clara County.
