ASSESSMENT DISTRICT NO. 75-63
1978-79 CHANGE AND MODIFICATION PROCEEDINGS

RESOLVED, by the Council of the City of Palo Alto, California, that
WHEREAS, this Council has conducted proceedings under and pursuant tc
Resolution No. 5604, A Resolution of Intention to Make Changes and
Modifications, adopted October 30, 1978, in which proceedin9s this Council has
confirmed and levi~d special assessments on the parcels of land to be
benefited by the acquisitions and improvements involved in said proceedings;
WHEREAS, said proceedings are being conducted under and oursuant to
Sections 13. 12.040 and 13.12.050 of Chapter 13.12 of Title 13 of the Palo Alto
Municioal Code and bonds are to be issued pursuant to Bond Plan G, Section
13.16.150 of Chapter 13. 16 of Title 13 of said Cede;
WHEREAS, Section 13. 16. 150(kk} of said Code provides that an action to
· determine the va 1i ii t_v of the assessment may be brought by this Council
pursuant to Chapter 9 {connencing "ith Section 860) of Title 10 of P.:i.rt 2 of
the Code of Civil Procedure of the State of California;
NOW, THEREFORE, IT IS ORDERED that Jones Hall Hill & White~ special bond
counsel for the City, are hereby authorized and directed to initiate and
prosecute to conclusion an action under the above cited code sections to
determine the validity of said confirmed assessment, including a determination
of whether said confirmed assessment is val id under Proposition 13~ and to
take such action as may be necessary therein.

a resolut1on duly passed and adopted by the Council of the City of Palo Alto.
