HomeMy WebLinkAboutRESO 5643' • ... . . •• 131SA '. • JHHW:KIJ:p4 RESOLUTION N0.-5.b!J A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS UNiVERSITY AVENUE AREA OFFSTREET PARKING ASSESSMENT DISTRICT NO. 75-63 1978-79 CHANGE AND MODIFICATION PROCEEDINGS (ALTERNATE Ill) 01/03/79 ORIGINAL RESOLVED, by the Council of the City of Palo Alto, California, that WHEREAS, a report has been prepared, approved and filed pursuant to Division 4 of the Streets and Highways Code for the change and modification proceedings with relation to certain acquisitions and improvements described in Exhibit A attached hereto and made a part hereby by reference; WHEREAS, this Council order-ed that the hearing on said approved report be held by it and fixed the time and place for said hearing, notice of which has been duly given; WHEREAS, at said hearing, said report, except as to the map, plat or diagram and the assessed valuations and the true valuations of and assessments and estimated assessments upon each parcel of land, was read before protests were considered, and the person who prepared said report appeared and gave all information concerning it to all interested property owners and to this legislative body; WHEREAS, a 11 persons interested desiring to be heard were fu 1 ly heard, and all oral protests or objections made at sa1d hearing by persons who would be entitled to protest or object to the ordering of the things proposed to be done at the hearing pursuant to the resolution of intention to make changes and modifications in the proceedings being conducted by this legislative body for the making of said changes and modifications, and all duly filed written protests by such persons and duly filed written protests relating to the regularity of sufficiency or validity of the proceedings under Division 4 of the Streets and Highways Code* including objections to the form, contents, validity or sufficiency of said report or of the notice of hearing thereon, were fully heard and considered; WHEREAS, said hearing was not continued from time to time for a period in excess of 120 days from the date fixed therefor, and this is the date designated by this legislative body for consideration of said t"eport, being within thirty days of the date of closing of said hearing; NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. That the owners of more than one-half of the area of the property to be assessed for said changes and modifications have not f11ed with the C1ty Clerk at or before the time fixed for said hearing, or at anv time before the adoption of the resolution of intention, or within the time ,~hen protests may be filed in the proceedings being conducted by this legislative body for said changes and modifications pursuant to the Palo Alto Municipal Code, or at all, written protests or objections. . 2. That the owners of more than one-half of said area to be assessed haYe not, either orally or in writing, protested or objected, and that such and all of said protests are hereby overruled. · 3. That said report and proceedings heretofore had thereon or therefor are valid and fully conform with the provisions of Division 4 of the Streets· ~ ... . . ;,, • and Hi9hways Code, arid all protests in writing relating to the regularity or sufficiency or validity of the proceedings, filed with said Clerk at or before the time fixed for said hearing, are hereby overruled. 4. That the publ 1c interest. convenience and necessity rea,uire safd changes and modifications set forth in said report, that said proposed changes and modifications and said project are feasible and the lands to be assessed w1ll be able to carry the burden of the proposed assessment, and the limitations on the amounts of the assessments provided for in said Division 4 may be disregarded, both with respect to the limitation on the district as a whole, an~ as to the limitation on individual, specific assessments. 5. (b) The total estimated cost of the proposed improvements, stating separately the estimated cost of each class of construc- tion proposed, including the incidental expenses of the proceed- ings, the total amount of which is separately stated, is shown upon the accompanying estimate of costs. (c) The total estimated costs, including the incidental expenses of the proceedings, the total amounts of which are sep- arately stated, of the proposed acquisitions, if any, are shown upon the accompanying estimate of costs. Where the acquisition of property for more than one purpose is involved, and any such purpose will require the acquisition of property or rights for which compensation must be made: which pro- perty or rights would not be req1Jired ff such purpose were omitted, the estimated costs of the property or rights acquired for such purpose are separately stated. (d) The assessed valuation of each parcel of land to be specially assessed, as shown on the last equalized assessment roll available on the date this report was commenced, is shown in the column entitled "(d)" in the accompanying tabulation, and the total assessed value of the land fs stated at the bottom thereof. Where the assessed valuation of any such parcel of land was not separately shown upon the assessment roll, an estimated assess- ed value of such parcel was made by the County Assessor whose roll was used in preparing the report. (e) The assessed value of the improvements upon each parcel of land to be specially assessed, as shown on the last equalized assessment roll available on the date this report was commenced, is shown fo the col!n entitled "(e)" in the t!lati on accompany- ing this report, and the total assessed value of the improvements on all such parcels is stated ~t the bottom thereof. (f-g} The true value of each parcel of land to be assessed is set forth in the column entitled "(f-9)" in the tabulation accompanying this report, and the total true value of all said lands is stated at the bottom thereof. Where the County assessment roll was used in paragraph (d) above, the true value of each parcel of land was determined by multiplying its assessed valuation by two. Where the City assess- ment roll was used, the true value of each parcel was determined by multiplying the assessed valuation of each such parcel by a prorate factor, which factor is double the quotient, expressed in two dee- ; ma l s , · of t he to t a l as s es s e d v a 1 u e of a 11 s u c h · 1 ands as s h own on the City assessment roll divided by such value as shown on the County assessment roll, as each such rolls for general tax pur- poses were available on the date this report was commenced. (h) The amount, a3 nearly as may be determir.ed, of the total principal sum of all unpaid special assessments and specidl assess- ments required or proposed to be levied under any completed or pending assessment proceedings, other than that contemplated in the instant proceedings, either direct or ad valorem, upon each parcel of land proposed to be assessed, which would require an investigation and report under said Division 4, if any, is des- cribed in column 11 (h)-i~ the accompanying tabulation. Where no such tabulation is provided, there are no such assessments. (i) The estimated amount of the assessment for the proposed acquisition and improvement to be levied upon each parcel of land to be assessed is as set forth in the column entitled n(i)" in the accompanying tabulation. Where this report is made in conjunction with a report under the Municipal Improvement Act of 1913, said assessments and the description of the several parcels of land upon which they are to be levied are contained in the diagram and assessment accompanying this report, and set opposite the identical parcel numbers as con- tained in the tabulation accompanying this report. If the assessment is to be made in proportion to the assessed value of land for the purpose of gen~ral taxation, then the total estimated cost of the acquisftf on or improvement l~ss the amount, if any, proposed to be paid towards the cost of such improvement or acquisition from any source other than special assessment upon benefited property and the assessed value of the lands to be assessed as shown on said last equalized assessment roll, is the basis for the computation of the assessment for each parcel. If the district is divided into zones, such proposed zones and the percentages to be assessed against each such zone are shown on the district map referred to under paragraph (a) hereof, and such estimated assessment is proportioned as nearly as may be acc~rding to such zones and percentages. AREA OPFSTREET PARKING ASSESSMENT DISTRICT PROJECT NO. 7~-~3 1978-79 CHANGE AND MODIFICATION PROCREOINGS RESO"CNED, by the Council of the City of Palo Al to, r.aJ Hornia, as follows: 1. rt is hereby preliminarily determinen that the public interest, convenience and necessity require, and it is the intention of tr.is Council to undertake change and modification proceedings with relation to certain acquisitfons and improvements, ann to assess the cost thereof on lands benefiten thereby, the general nature, location a11d extent of said acquisitions and improvements and the general nature and extent of said change and modification proceedings being described in Exhibit A attached hereto and made a part hereof by reference. 2. The costs of said proposed acquisitions and improvements will be assessed upon lands in an assessment district, the exterior boundaries of which district are shown on a map thereof on file in the office of the City Clerk, to which r~ference ic hereby made, which map indicates by a boundary line the territorv included in the proposed assessment district and which shall goverr. fo~ all details as to the extent of the assessment district. 3. Proceedings for said acquisitions and improvements shall be conducted pursuant to Division 4 of the Streets and Highways Code (the Special Assessment Investigation, Limitation and Ma~ority Protest Act of 1931) and Sections 13.12.040 and 13.12.050 of Chapter 13.12 of Title 13 of the Palo Alto Municipal coae and bonds shall ~e . Mayor APPROVED: Bond Counsel 2 . . . •• .. . . .. .. • EXHIBIT "A" (1) The general nature, located ann extent of the proposed acquisitions and improvements are as follows: (a) The acquisition of (i) properties known as 427 and 435 Bryant Street (the "old Safeway loth) located between Florence Stre~t and Bryant Street contiguous to and northwesterly of the alley running from Bryant Street and Florence Street, and {ii) properties known as 412 and 420 Kipling Street and 424 and 440 Lytton Avenue located at the northerly corner of Kipling Street and Lytton Avenue. (b) The relocation of persons ann businesses located on sain properties, the demolition of existing structures ana the improving thereof as public off-street vehicle parking facilities by grading ana the construction therein of base pavement, wearing surface, curbs, gutters, ~ralnage facilities, lighting facilities, striping, landscaping and all auxiliary work necessary to complete the same as off-street automobile parking faci U. ties. (c) The financing of a feasibility study for ana on behalf of the area of the assessment di.strict which wi 11 encompass the following matters: (1) Improvements to on-street parking and landscaping; (2) Improvements to off-street parking; (3) The feasibility of constructing a downtown parking structure; (4) Possible acquisition and improvement of additional off-street parking; (5) Opportunities for encouraging and providing for alternative transportation mones for employees and customers, including but not limited to van pools; mini-buses, shuttle buses, bicycles, handicapped, and pedestr~ans; (6) Multiple use of parking properties and structures, including existing as well as new ones, taking into account that "economics" of parJdr:g structures are short-term considerations in light of values such as street-life scale, interest and enclosure: and (7) Checking or monitoring Saturday parking. (d) The acquisition of all lands, easements an6:facilities and the construction of all work auxilliary to any of the above and necessary to complete the same. Reference is hereby made to the plat showing the nature, location and extent of said acquisitions and improvements for a further descr iptior1 of said work and for all particulars relative thereto, which plat is on file in the office of the City Clerk as part of the report and open to public inspection. . . . •• ...
