FILING OF NOTICE OF DETERMINATION
UNIVERSITY AVENUE AREA OFFSTREET PARKING
ASSESSMENT DISTRICT PROJECT NO. 75-63
1978-79 CHANGE AND MODIFICATION PROCEEDINGS

ORIGINAL
RESOLVED, by the Council of the City of Palo Alto, California, that
WHEREAS, the City staff has duly processed a negative declaration
covering the changes and modifications described as Alternate III in the
N otice of Continued Hearing, dated January 15, 1979 (herein called the
nproject") in the time, form and manner required by the California
(nvironmental Quality Act and by law; and
WHEREAS, this Council has duly read and considered said negative
declaration and is fully informed in the premises,
NOW, THEREFORE, it is ORDERED as follows:
1. The negative dee 1 arat ion for the Project is hereby approved and
declared to be legally adequate and effective.
2. The Project is hereby approved11 subject to the taking of special
assessment and assessment bond proceedings for the construction and financing
thereof.
3. The City Planning Officer is hereby authorized and directed to file
a Notice of Detennination as to the Project in the office of the County Clerk
in the form and manner required by law.

a resolution duly passed and adopted by the Council of the City nf Palo Alto,
California. at a meeting thereof held on the 29th day of January , 197 ,

Notice is hereby given that the public hearings duly fixed and held on
January 8, 1979, in the Council Chant>erst City Hall, Palo Alto. California,
have been duly cuntinued to Monday, January 29, 1979, at the hour of 7:30 P.M.
in the Council Chaneers, C1ty Hail, 250 Hamilton Avenue, Palo Alto, California.
The sub!ects of the hearings are set forth in the "Notice of Hearing on
Written Report Under Division 4 of the Streets and Highways Code and of Time
and Place Thereof", dated November 22, 1978, and mailed to all property owners
in the assessment district, and in Resolution-No~ 5604, A Resolution of
Intention to Make Changes and Modifications, adopted by the Council on October
30, 1978;
Provided. However, that the Council proposes to consider the approval of
any one_~f the following three alternatives:
_L\lterrrate I. Complete tti.e acquisitions and improvements as generally
described in Resolution of Intention No. 5242 and in the Engineer's Report
approved pursuant thereto (including landscaping of the properties at 424 and
440 Lytton Avenue), but increase the total Engineer's Escimate of Cost and the
total principal amount of bonds proposed to be issued from $791,000 to
$966,000; or
Alternate II. Complete a smaller parking lot on properties known as 412
and 420 Kipling Street and abandon the acquisition and f111>rovement of
properties known as 424 and 440 Lytton Avenue at the southwesterly corner of Kipling Street and Lytton Avenue; or
Alternate III. Same as Alternate I, except provide for parking spaces
on the properties at 424 and 440 Lytton Avenue, instead of landscaping of said
properties.
