HomeMy WebLinkAboutRESO 5629• ORIGINAL RESOLUTION NO. 5629 ---- RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING THE MISCELLANEOUS DIVISION OF LANO AT 821-827 HAMILTON AVENUE AND GRANTING EXCEPTIONS WITH CONDITIONS WHEREAS, 20,000 square feet of property zoned R-1 and located at 821-827 Hamilton Avenue in the City of Palo Alto, hereinafter referred to as the "subject property1' is proposed to be divided into three (3) lots; and WHERFAS, lots in an R-1 (Single-Family Residence District Regulationr) zone district are required by Section 21.20.110 -0f the Palo Alto Municipal Code to have a width of 60 feet and a depth of 100 feet and rear lots are required by Section 21.32.050 of the Palo Alto Municipal Code to have f ~ontage on a public street over land under the same ownership as the rear lot: and WHEREAS, Section 18.12.050 of the Palo Alto Municipal Code requires front arid rear setbacks of 20 feet; and, \-w"HEREAS, proposed lots A and B are 50 feet in width where 60 feet is required, lot C is 80 feet deep where 100 feet is required, access to the rear lot is by easement rather than fee title, and existing buildings do not meet required setbacks. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that there are special condi- tions affecting the lots, including the fact that the depths of lots A and B exceed that required and the areas of said lots meet those re- quirements, the width of lot C exceeds that required and has more than the mini~um lot area required for a rear lot and that the exceptions and variance granted herein are necessary for the preservation and enjoyment of a substantial property right of the petitioner, and.that the excep- tions granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this property is situated. The Council further.finds that the project, including design and improvements, is consistent with the adopted Comprehensive Plan; that the site is physically suitable for the type and density of the pro- posed development; that the project is not likely to result in serious health problems; and that there are no conflicts with public easements. SECTION 2. The City council hereby approves the Miscellaneous . Division of Land for the subject property, as shown on the map attached hereto and incorporated herein by reference, and grants the exceptions to the sixty (60) foot width requirement for lots A and B, to the one hundred foot depth requi£ement for lot c, and to the requirement of frontage upon a public street for lot C, as provided in Chapter 21.28 of the Palo Alto Municipal Code and a variance from the setback require- ment for the existing buildings, with the following conditions: a. The two sheds located on the northeast and southwest prop€rty lines shall be removed as indicated on the map; b. An agreement for a common access easement for all three prop- erties shall be executed satisfactory to the City Engineer and City Attorney, c. Separate utilities and meters to each· parcel shall be installed to the satisfaction of the Utilities Department; d. The two rear cottages shall be combined into one dwelling unit. · · The conditions must be fulfilled within 180 days or an agreement executed and a bond provided satisfactory to the City Attorney. SECTION 3. The City Council hereby find3 that the proposed pro- ject will not have a significant impact on the environment.
