RESOLUTIOU UO. 5524 RESOLUTIOH OF THE COUUCIL OF THt CITY OF PALO ALTO DESCRIBIUG THE PROCESS FOR I.UPLEHEUTATIOH OF THE FEDERAL AID URBAH PROGRAM IN SAUTA CLAPu\ COUHTY ORIGINAL UlffiREAS, the Federal Aid Highway Act of 1973 provides Federal funds for expenditures on the Federal Aid Urban (FAU) Sy~tem of Highways, or undE'!r certain conditions, for public transportation projects; and tm.EREAS. the FAU System consista of State highways, city streets and county roads located within urban an~as an<l urbanized areas of the State; and WHEREAS, the State Department of Transportation has required that each urbanized and urban area nust have a cooperative process to produce programs identifying local projects, transit projects and regional hi!:hway projects, including State highway projects; and WHEREAS, the cooperative process cust involve the cities, the County, the County Transit District, the Metropolitan Transportation Commission (MTC), and the State; and WHEREAS, before Federal aid will be made available for Urban System Projects within the County of Santa Clara. the process for determining project priorities and developing a five (5) year pro- gran for the fiscal year coI!llllencing July 1, 1976, must be approved by MTC with regard to the regional interest, and by the State De- partment of Transportation; and rnIEREAS, the County of Santa Clara has been designated as the Lead Agency for purposes of developing the cooperative process in Santa Clara County~ NOtl> THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows· The Council hereby approves the following process and pro- cedures as a Uemo of Un~erstanding for determining Federal Aid Urban System Project priorities and developing a five (5) year Federal Aid Urban System Program and requests that they be approved by the State Departnent of Transportation: SECTION I. A. The California Transportation Commission is requested, in the process of allocating FAU funds to Santa Clara County, to consider allocation in accordance with the following: 1. Fifty percent (50%) for regional transportation, including public transportation. 2. The remaining fifty percent (50%) to the County of Santa Clara and the City of San Jose in accordance with the fol- lowing provisions and conditions: ' .. (a) The County of Santa Clara shall be apportioncJ a suo determined by the proportion that the total population cf the unincorporated portions of the County of Santa Clara bears to the total population of the entire County as a geographical area; and, in addition. the County of Santa Clara shall, for the fiscal years f976-77 and 1977-78 only, rer.eive the SUI!l that would otherwise be allocated to the Gilroy urban area for such fiscal years. (b) The City of San Jose shall be apportioned a sum determin~d by the proportion that the total population of the City of San Jose bears to the total population of the County of Santa Clara as a geographical area. (c) The balance remaining, after apportionment of amounts under (a) and (b). shall be allocated to the City of San Jose in consideration of the additional administrative costs and pro-cedures and matching funds which will be required of and undertaken by the City of San Jose to implement FAU programs, subject, however, to the further conditions and agreements required of the City of San Jose set forth hereafter in this Section. B. Within 45 days after the City of San Jose receives FAU funds under Section IA2(c), the City of San Jose shall allocate and pay to the cities hereinafter described, sums determined in accor- dance with the followi~-..g: 1. A "base figure" shall be deteroined by muitiplying 70% times the amount which is subject to allocation as a "remaining balance" undeL" Section IA2(c). 2. The City of San Jose shall allocate and pay to each incorporated city in the County of Santa Glara (excluding San Jose; and excluding Gilroy for the fiscal year 1976-77 and 1977-78 only) a sum determined by that proportion of the ''base figure11 which the total population of such city bears to the total population of all cities within the County of Santa Clara as a geographical area (excluding San Jose; and excluding Gilroy for the fiscal years 1976-77 and 1977-78 only). C. Population shall be determined in the same manner as pro- vided for census and estimates by the Population Research Unit of the State Department of Finance; a population deten!lination or estimate as made shall re.I!lain in full force and effect until a sub- sequent determination, estimate, or revision thereof made thereby. D. For each yearly period commencing July 1, 1976, alloca- tions under this Section shall be made in accordance with popula- . tion so determined by the Department of Finance for the immediately preceding January. Appendix A illustrates the distribution per- centages as of January 1, 1977. E. Each city shall spend funds received under this coopera- tive program for the Federal Aid Urban System or legal gas tax fund purposes. ~TION 11. The five (5) year FAU program will be developed by a cotm!littee which includes a representative from the County of Santa Clara, the City of San Jose., CALTRAUS and MTC. -2- .. A. Th~ five (5) year program may include projects submitted by CALTRAHS, the County Transit District, the City of San Jose and County of Santa Clara. B. The following distribution of FAU funds will be used as a guideline in the development of the five (5) year FAU progran: Regional Transportation 50% (including public transportation) City of San Jose Projects 4li. 7% County of Santa Clara Pro.iects 5.3% C. The following criteria will be used in evaluating projects and developing a five {5) year program: (1) State of readiness (status cf plans, specifica- tions, estimate, EIR, approvals, agreements, etc.). (2) Benefit to public transportation system. (3) Transportation corridor benefit. (4) Benefit to total transportation capacity (ability to handle person trips per day). (5) Benefit to other segments of the regional and local highway syst~m. (6) Benefit to accident history. (7) Community and environmental consideration. The cities and county government, having developed thf! five (5) year program of projects for FAU funding contained in the current regional transportation plan of HTC, hereby acknowledge that all projects programmed for the next succeening fiscal year and contained therein are of equal oerit and that, therefore, it is appropriate that the funding of those projects should be en the allocation basis stated herein. D. The five (5) year FAU Prograra will be approved by the Council of the City of San Jose and the County Board of Supervisors. The County Transportation Commission will provide an advisory recom- mendation on the public transportation projects in the FAU Program. The five (5) year FAU Program shall be then transmitted by March 1 of each year to the Metropolitan Transportation Cormnission for re- view and approval with regard to the regional interest and to the State Director of Transportation for approval. E. Said five (5) year prog-ram shall be reviewed and revised each year to include additional projects as submitted by eligible agencies and revisions shall Le c:a.pproved as provided in Section IID. F. By written notice filed with the Metropolitan Trans- portation Commission and County of Santa Clara on or before January 15 of any calendar year commencing in 1979> the allocation process in Section I may become inoperative at th2 election of either the City of San Jose or a majority of all ci~ies (other than San Jose) who represent a majority of the populat:ion of such cities~ as to -3·· FAU funds subject to apportionment or allocation for periods commencing it:1111ediat1~ly subsequent to the first day of July there.· after. SECTIOH III. The above described process will be reviewed and approved in the following manner: A. The process will be referred to each city's legislative body and must be approved by: (1) The majority of cities in the County eligibl~ for the FAU program. (2) Cities in the County representing the najority of the eligible population, (3) Cities in the County with over 200,000 population (the City of San Jose). B. Once the requirements defined in Section IIIA above are satisfied, the process shall be submitted to the County Board of Supervisors for approval. C. One~ approved by the Board of Supervisors, the process shall then be transmitted to the ~1etropolitan Transportation Commission for approval with regard to the regional interest and to the Director of the State Department of Transportation. SECTIOU IV. The highway system shown on the map on file in the Public Works Department of the City of Palo Alto hereby is approved. SECTior~ V. The Council finds that this is not a project and, therefore, no environmental impact assessment is necessary.
