RESOLUTION NO. 5617
RESOLU!l'ION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LANO AT
853 MIDDLEFIELD ROAD AND 738 HOMER COURT AND
GRANTING EXCEPTIONS-
WHEREAS, 28,750 square feet of property zoned RM-4 (.Mediwn
Multiple Family Residence District Regulations) located at 853
Middlefield Road and 4,386.75 square feet of property zoned R-1
(Single Family Residence District Regulations) located at 738
Homer Court in the City of Palo Alto, hereinafter referred to
as the "subject property" is currently two separate lots but
it has been proposed to redivide the lots with different measure-
ments; and
WHEREAS, the lot in tha R-1 zone is required by Section
21. 20 .110 of the Palo Al to Municipal Code tc>" have· a· depth of
100 feet and a width of sixty (60) feet and frontage on· a public
street and with the transfer of 25-foot by 100-foot strip of
vacant land from 853 Middlefield Road to subject property still
fails to have the required width of sixty (60) feet and lacks
frontage on the public street; and
WHEREAS, the width and lack of frontage on a public street
of subject property require exceptions from said_ requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
conditions affecting the lots and they are as follows:
a. The substandard width and lack of frontage at
738 Homer Court existed before this miscellaneous land division,
and are not altered by it, and this is a special circumstance
or condition affecting the property:
b. The exceptions are necessary for the preservation
and enjoyment of a substantial property right of the petitioner:
and
c. The granting of the exceptions will not be detrimental
to the public welfare or injurious to other property in the
territory in which the property is situated.
SECTION 2. The City Council hereby approves the miscellaneous
division of land for the subject property as shown on the map
attached herein and incorporated herein by reference, and grants
the exception to the sixty (60) foct width and lack of frontage
requirement at 738 Homer court as provided in Chapter 21.2S
of the Palo Alto Municipal Code.
SECTION 3. The City Council hereby finds that the proposed
project will_ not have a significant impact on the envirorunent.
