RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LAND A'r
4270 ~..ANUELA WAY AND GRANTING LXCEPTIONS WITH
CONDITIONS
WHEREAS, 80,020 square feet of property zoned R-E (Residential
Estate District Regulations) and located at 4270 Manuela Way
in the City of Palo Alto, hereinafter referred to as the ~subject
property"· is propcseci to be divided into twe· (2) lots; and
WHEREAS, lots in an R-E zone district are required by
Section 21.20.110 of the Palo Alto Municipal Code to have a
minimum lot size of one (1) acre and the proposed lots fail
to have the minimum lot size; and
WHEREAS, the lot size stated above requires exceptions
from said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
conditions affecting the lots and they are as follows:
a. The existence of other substandard lots in the
immediate vicinity, and the fact that the design of the access
to lot 2 is the same as the access which now exists and functions
satisfactorily are special circumstances affecting the property.
b. The exceptions are necessary for the preservation
and enjoyment of a substantial property right of the petitioners.
c. The granting of exceptions from the require.TUent
for a one acre area will not be detrimental to the public welfare
or injurious to other property in the territory in which the
property is situated because the proposed lots are consistent
in size with the present land use pattern, and the access ease-
ments affect only the subject parcels and the adjacent parcel
from which an easement is to be obtained.
SECTION 2. The City Council hereby approves the Miscellaneous
Division of Land for the subject proper.ty, as shown on the map
attached herein and incorporated herein by reference, and grants
the exceptions to the lot size requirement as_ provided.in Cha~ter
21.28 of the Palo Alto Municipal Code with the following conditions:
a. Bond Series Di72 be paid off or segregated.
b. All property corners be monumented.
c. The cottage straddling the new prop~rty line be
removed.
d. A paved turnaround area be provided on Lot 1 as
shown on the map with the addition that a smooth transition
be provided from the 20-foot wide paved width to· the 10-foot
wide driveway leading into Lot 2, and smooth transitions to
existing curb and gutter.
e. As an alternative to the.requirement of the sub-
division ordinance that conditions of approval be met within

180 days, the applicant be allowed to enter into a subdivision
agreement satisfactory to the City Attorney and to post a Nine
Thousand Dollar ($9,000) bond guaranteeing that Conditions (c)
and (d) will be met before final inspection of a house on Lot
1.
f. The paved turnaround on Lot· 1 be designated "clear
for emergency vehicle turnaround" on the final map.
g. An access easement be executed for the existing
paved area at 4264 Manuela Way currently used for access to
4270 Manuela Way so as to allow permanent use of this area for
access to Lots 1 and 2 at 4270 Manuela Way.
SECTION 3. The City Council hereby finds that the proposed
project will not have a significant impact on the environment.
