A RF.SOLUTION OF PREI,IMINARY DETERMINATION AND
DIRECTING PREPARATION OF REFORT UNDER DIVISION
4 OF THE STREETS AND HtnHWAYS CODE

1Q78-79 CHANGE AND MODIFICATION PROCEEDINGS
RESOLVED, by the Council of the City of Palo Al to, r.aJ i_fornia,
as follows:
1. rt is hereby preliminarily determined that the public
interest, convenience and necessity require, and it is the intention
of this council to undertake change and modification proceedings
with relation to certain acquisitions and improvements, and to
assess the cost thereof on lands benefited thereby, the general
nature, location and extent of said acquisitions and improvements
and the general nature and extent of said change and modification
proceedinqs being described in Exhibit A attached hereto and made a
part hereof by reference.
2. The costs of said proposed acquisitions and improvements
will be assessed upon lands in an assessment djstrict, the exterior
boundaries of which district are shown on a map thereof on file in
the office of the City Clerk, to which reference is hereby made,
which map indicates by ~ boundary line the territorv included in the
proposed assessment district and which shall govern for all detail~-
as to the extent of the assessment district.
3. Proceedings for sain acquisltions and improvements shall
be conducted pursuant to Division 4 of the Streets and Highways
Code {the Special Assessment Investigation, Limitation and Majority
Protest Act of 1931) and Sections 13.11.040 and 13.12.050 of Chapter
13 .12 of Title 13 of the Palo Al to Municipal Code a-na bonds shal 1 be

issued pursuant to Bond Plan G, ~ection 13~16.050 of Chapter 13.1~
of Title 13 of sai~ Codei provtded, however, that there shall be no
specific lien assessments levied as provided in said Bond Plan G in
connection with said change and modification proceedings.
4. The City Engineer js directed to procure the required
information for and prepare a written report upon sain proposed
changes and modifications in said acquisitions ahd iwprovements, to
be completed and filed with this legislative body.within one year
from the date of adoption of this resolution, which report shall
contain the information required pursuant to Section 282~ of the
Streets and Hiqhways Code. A copy of this resolution shall he
attached to said report.

~XHIBIT "A"
(1) The general nature, located and extent of the proposed
acquisitions and improvements are as follows:
(a) The acquisition of Ci) properties known as 427 and 435-
Bryant Street (the "old Safeway lot") locate~ betwean
Florence Street and Bryant Street contiguous to and
northwesterly of the alley running from Bryant Street and
Florence Street, and {ii) properties known as 412 and 420
~ipling Street and 424 and 440 Lytton Avenue located at
the northerly corner of Kipling Street and Lytton Avenue.
(b) The relocation of persons and businesses located on sai~
properties, the demolition of exjsting structures and the
improving thereof as public off-street vehicle par~ing
facilities by grading and the construction therein of
base pavement, wearing surface, curbs, gutters, nrajnage
f~cilities, lighting facilities, striping, landscaping
and all auxiliary work necessary to complete the same as
off-street automobile parking facilities.
Cc} The financing of a feasibility study for sna on behalf of
the area of the assessment district whicn will encompass
the following matters:
(1) Improvements to on-street parking and landscaping:
<2) Improvements to off-stre~t parking:
(3) The feasibility of constructing a downtown parking
structure:
(4) Possible acquisition and improvement of additional
off-street parking1
(5) Opportunities for encouraging and providing for
alternative transportation modes for employees and
customers, including but not limited to van pools,
mini-buses, shuttle buses, bicycles, handicapped,
and pedestr~ans:
(6) Multiple use of parking properties and structures,
including existing as well as new ones, taking into
account that "economics" of parking structures are
short-term considerations in light of values such as
street-life scale, interest and enclosure1 and
17} Checking or monitoring Saturday parking.
{d) The acquisition of all lands, easements and facilities
and the construction of ail-work auxilJiarv to any of the
above and necessary to complete the same. -
Reference is hereby made to the plat showir.g the nature,
location and extent of said acquisitions and improvements for a
further description of said work and for all particulars relative
thereto, ~hich plat is on file in the office of the City Clerk as
part of the report and open to public inspection.

(2) The nature and extent of the proposer chanqes ann
modifications are to change the total Engjneer's Estimate of Cost
and the total principal amount of assessment bonds to be issued from
$791,000 to $966,000.
