RESOLUTION NO. 5600
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF IJ\ND AT
588 MATAOERO AVENUE AND GRANTING EXCEPTIONS
WHEREAS, 17,282 square feet of property zoned R-1 and located
at 588 Matadero Avenue in the City of Palo Alto, hereinafter referred
to as the "Subject Property" is proposed to be divided into two
(2) lots; and
WHEREAS, lots in an R-1 (Single-Family Residence District
Regulations) zone district are required by Sectiori 21.20.110
of the Palo Alto Municipal Code to have a depth of 100 feet and
the pzoposed lots fail to have this depth: and
WHEREAS, all lots created by a miscellaneous division of ·
land shall have frontage on a street dedicated as a public street
and one of the lots does not have usable frontage on a public
street because of the presence of a creek: and
WHEREAS, the depth and lack of frontage stated above require
exceptions from said requirements.
NOW, THEREFORE, the Council of the City of·Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
circumstances including the facts that the two parcels do meet
area requirements, although they are substandard· in depth and
a creek passes through the front of the property and that the
exceptions granted herein a.~e necessary for the preservation and
enjoyment of a substantial property right of the petitioner,
and that the granting of exceptions from the requirements for
a 100-f oot depth for both lots and frontage on a public street
for Lot A will not be detrimental to the public welfare or injurious
to other prope%~Y in the territory in which the property is situated
because the proposed lots are consistent in area·w~th other lots
in the immediate vicinity.
SECTION 2. The City Council hereby approves the miscellaneous
division of land for the subject property, as shown on the map
attached herein and incorporated herein by-reference, and grants
the exceptions to the one hundred (100) foot depth requirement
and the frontage requirement as provided in Chapter 21.28 of the
Palo Alto Municipal Code with the conditions that:
1. The existing house be demolished or moved to one of the
new parcels and, if moved, a covered parking space be provided
en that same parcel;
2. The existing garage be removed;
3. A registered civil engineer certify that· the existing
bridge will support a 33,000-pound emergency vehicle;
4. A fire hydrant be installed at the developer's expense
within 150 feet of the rear building;
5. An access easement be granted from Lot· B·to Lot A over
the ~xisting bridge and a portion of the driveway under the ownEr-
ship of Lot BJ

6. Public Utility easements be granted for service to Lot
7. The map be corrected to show the location of both Santa
Clara Valley Water District (SCVWD) easements;
8. Storm drain outfalls and grading be carried out in accordance
with SCVWD requirements;
9. Any existing wells on the parcel and their proposed
use be reported to the scvwo in accord with District Ordinance
75-61
10. No variances from the site Development Regulations of
the R-1 zone will be allowed and;
11. No variances for projections will be allowed except
as permitted under Section 18.88.090(a) of the Palo Alto Municipal
Code.
SECTION 3. The City Council hereby finds·that the proposed
project will not have a significant· impact on the environment.
