RESOLUTION NO. 5599
RESOLUTIO?J OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LAND AT
431 WAVERLEY/430 KIPLING AND GRANTING EXCEPTIONS
WHEREAS, the subject property consists of two separate properties
being a 50 foot by 112.S foot lot known as 430 Kipling and a 50
foot by 105.5 foot lot known as 431 Waverley1 and
WHEREAS, the two are proposed to be joined into one lot;
and
WHEREAS, lots are required by Section 21.20.110 of the Palo
Alto Municipal Code to have a width of 60 feet and the proposed
lot fails to have-this width; :and
WHEREAS, Section 21.20.140 of the Palo Alto Municipal Code
prohibits interior lots with double frontage and the subject
property will have frontage on Waverley and Kipling Streets;
WHEREAS, the width and double frontage stated-above requires
exceptions from said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
conditions affecting the lots, iµcludin9 the facts tjlat the sub-
standard width existed before this miscellaneous-land division
and is not altered by it and that the exceptions granted herein
are necessary for the preservation ~~d enjoyment of a substantial
property right of the petitioner, and that the exceptions granted
herein will not be detrimental to the public welfare or injurious
to other property in the territory in which this property is
situated, and rather will improve traffic and pedestrian conditions
on Waverley Street by removing loading from the· public street.
SECTION 2. The City Council hereby approves the Miscellaneous
Division of Land for the subject property, as shown on the map
attached herein and inco~;>0rated herein by reference, and grants
the exceptions to the 60 foot width require.~ent·and the require-
ment that interior lots not have double frontage as provided
in Chapter 21.28 of the Palo Alto Municipal Code with the condi-
tion that the main entrance to the existing commercial building
will be 431 Waverley and the back of the building will be an
employee entrance plus shipping and receiving,·and for future
assessment purposes 431 Waverley will be considered as the front
and 430 Kipling will be considered the rear.
SECTION 3. The City Council hereby finds that· the proposed
project will not have a significant impact on the environment.
