HomeMy WebLinkAboutRESO 5594• e ORIGINAL RESOLUTION NO. 5594 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING A MISCELLANEOUS DIVISION OF LAND FOR PROPERTY LOCATED AT 810-830 LOS TRANCOS ROAD NEAR ALPINE ROAD AND GRANTING EXCEPTIONS, SUBJECT TO CONDITIONS WHEREAS, 29.44 acres of property zoned o-s located on the easterly side of Los Trancos Road approximately one-half mile from its intersection with Alpine Road in the City of Palo Alto, being a portion of Rancho El Corte de Madera and identified as Assessor's Parcel No. 182-36-009, hereinafter referred to as the "subject property", is proposed to be divided into three parcels; and WHEREAS, the proposal will create three parcels, Lot 1 and Lot 2 consisting cf 10 acres each and Lot 3 consisting of 9.4 acres; and WHEREAS, Lot 3 is a rear lot which is required by Section 21.32.0SO(b} of the Palo Alto Municioal Code to have an area which exceeds the 10-acre lot area requirement of the 0-S District by 20 percent exclusive of any access to a public street; and WHEREAS, Lot 3 therefore is substandard in area by 0.6 acres under o-s District regulations, and by 2.6 acres under rear lot regulations, requiring an exception from the requirements of Section 21.32.0SO(b) of the Palo Alto Municipal Code1 and WHEREAS, Lot 2 and Lot 3 do not have frontage on a public street as required by Section 21.32.0SOCc) of the Palo Alto Municipal Code~ NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as foilows: SECTION 1. The Council finds that there are special con- ditions affecting Lots 2 and 3 due to the dimensions and geometry of the parcels1 tha~ the e~ceptions granted herein are necessary for the preservation and enjoyment of a substantial property right of the petitioner~ and that the exceptions granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this property is situated. SECTION 2. The Council hereby approves a miscellaneous divisIOii of land into three parcels, designated as Lot 1, Lot 2, and Lot 3, for the subject property, as shown on the map attached hereto and incorporated herein by reference, and grants the exception to the area requirements of Sections 21.32.0SO{b) and 18.71.070 of the Palo Alto Municipal Code for Lot 3 and the exception to the street frontage requirements of Section 21~32.0SO(c) for Lots 2 and 3, subject to the followin9 conditions: a. Access from Los Trancos Road must be capable of sup- porting 33,000 pounds of fire apparatus during_ all weather, must have a 20-foot all-weather surface, must have a clear 13-foot overhead clearance, must have an incline not in excess of 15 percent, and must meet the vertical and horizontal curves estab- , ' lished for fire apparatus. The road improvements shall be installed prior to City approval of the parcel map, or an agreement shall be executed and a bond shall be posted by the subdivider, in the amount to be determined by the City, prior to City approval of the parcel map, to ensure completion of road improvAments. · b. Prior to City approval of the parcel map, the sub- divider shall execute an agreement, subject to approval by the City Attorney, for continual maintenance of c. the private access road in the subdivision to the standards required by the Palo Alto Fire Department. Such agreement shall be recorded and shall run with the landft The owners of all lots shall have non-exclusive right of ingress and egress along the proposed access road. d. The developer shall provide for drainage along the proposed 20-foot road within the subject property subject to the approval of the City Engineer. s. Cut and fill slopes shall not exceed one and one-half hori- zontal to one vertical. All slopes shall be protected with native plants to prevent erosion. f. Each parcel in the subdivision shall be required to have an adequate on-site domestic and emergency water supply designed to meet all applicable City codes and specifications. To this end, the subdivider shall either install a six-inch public water main to each lot, granting a 20-foot wide public utility easement to accommodate this water line, and install fire hydrants to each lot, or secure County Environmental Agency approval .for installing wells at each lot. The water supply must have sufficient capacity to satisfy Fire Department requirements. Design of the water line and placement of hydrants is subject to approval by the City. The water line and hydrants shall be installed prior to City approval of the final parcel map or an agree.~ent shall be executed and a bond shall be posted by the subdivider, in the amount to be determined by the City, pi:.<.or to City approval of the final parcel map, to ensure completion of these improvements. g. The developer shall pay all extension charges to each · parcel to Pacific Gas and Electric Company unless Pacific Gas and Electric Company refuses to serve. Then the developer shall pay extension charges per City Schedule E-5. Internal subdivision lines shall be underground .. h. The developer shall apply to the County of Santa Clara Health Department for approval of septic syst.ems installations, prior to approval of final map. i. 'l'he developer shall submit an offer of dedication to the City of Palo Alto for road purposes a strip of land 40 feet wide lying equally on each side of th~ existing centerline of Los Trances Road as such road or any ~art thereof falls within the limits of the sub3ect property to the satisfaction of the Director of Publtc Works. · k~ The access road must be flared at Los Trances Road to provide a sight distance of approximately 200 feet in each d1rect1on. l~ No bu1ld1nq permits shall be issued until all the above cond1t1ons have been met and the final map· has been approved and recorded. SECTION 3. The Council finds that granting crf-the proposed mis- c:.= 11 an·e·a·us· dl..v1sion of land and the exceptions· granted will have no s1gnif icant environmental impact.
