RESOLUTION NO. 5585 e ORIGINAL RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING THE TENTATIVE SUBDIVISION MAP FOR THE PROPERTY LOCATED AT 3865 PAGE MILL ROAD IN THE CITY OF PALO ALTO AND GRANTING EXCEPTIONS SUBJECT TO CONDITIONS WHEREAS, 30 acres of property zoned o-s (Open Space District Regulations) and located at 3865 Page Mill Road in the City of Palo Alto, being shown on the Parcel Map of Ina Dahl and Harry Aine, recorded in Book 404-of Maps, Page 16, Santa Clara county Records, and identified as Assessor's Parcel Number 351-05-031 hereinafter referred to as the "subject property", is proposed to be divided into three (3) ten-acre parcels~ and WHEREAS, Parcels 2 and 3 are required by Section 21.32.050 to have frontage on a public street and fail to have such frontage; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that there are special conditions affecting Parcels 2 and 3; the exceptions are necessary for the preservation and enjoyment of the substantial property right of the petitioner; the granting of the exceptions will not be detrimental to the public welfare or injurious to other property in the territory in which the property is situated. SECTION 2. The City Council hereby approves the tentative subdivision map for the subject propert~, as shown on the map attached hereto and incorporated herein by reference, and grants the exceptions to the requirements of Section 21.32.050 of the Palo Alto Municipal Code, subject to the following conditions: a. No permits shall be issued for any grading or construction on Parcels 1,2, and 3 until all_ provisions of Council Resolution 5351 of February 14, 1977 or of any agreement executed in compliance with said provisions have been complied with. b. Easements for power lines and water lines shall be dedicated on the parcel map as required by the Department of Utilities. c. The subdivider shall construct the water line tc each lot, from present termination point at boundary of Parcel 2. d. The subdivider shall ,·construct power lines to each lot pursuant to requiremBnts of the Light and Power Division. e. Septic tank.; may be used for sewage disposal subje.;;t to but not limited to the following conditions and requirements of the County Environmental Health Agency; . •• (1) Septic tank permits will be issued for sewage disposal systems in this subdivision provided the applications are in compliance with Chapter 16.10 of the Palo Alto Municipal Code. All lots will require 300 feet of drainfield, plus area of 100% expansion and a 1,500-gallon septic tank. (2) Tl1e septic tan~ permit must be obtained by the applicant prior to the issuance of a building permit. {3) No portion of the sewage disposal system may be installed within 50 feet of any swales. (4) Obtain water for domestic purposes from the City of Palo Alto Department of Utilities. {5) Prior to any excavation on the property, contact Environmental Health Services regarding place- ment of fill. (6) Due to the steep topography of the lots, the size and location of the houses may have to be restricted to allow for installation of a septic tank system in accordance with the Palo Alto Municipal Code. f. Extension of the private read to serve parcel 3 shall be constructed by the subdivider subject to the requirements of the City Engineer and Fire Department, and shall be installen prior to issuance of any permits for improvements on Parcel 3, g. Fire hydrants must be installed pursuant to require- ments of the Fire Department prior to issuanc'! of any permits for improvements on Parcels 2 and 3. h. Condition b shall be complied with pursuant to Chapter 21.32.110 of the Palo Alto Municipal Code within one year, prior to recordation of the final map and the required improvements shall be completed pursuant to Chapter 21.32.100 within one hundred eighty (180) days of Council approval of the map, and provided that in lieu of constructing any required improvements on the property, the subdivider may enter into an agreement pursuant to Chapter 21.24 to the satisfaction of the City Attorney and affected Cit~, departments. SECTION 3. The City Council hereby finds that the proposed project will not have a significant impact on the environment.
