RESOLUTION NO. 5584
RESOLUTION OF THE COUNCIL OF THF CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIV~SION OF LAN~ AT
1050-52 CALIFCRNIA AVENUE AND CRANTING EXCEPTIONS
WITH CONDITIONS
WHEREAS, 17,527 square feet of property zoned R-1 and lo-
cated at 1050-52 California Avenue in the City of Palo Alto,
hereinafter referred to as the "Subject Property" is proposed
to be divided into two (2) lotSi and
WHEREAS, lots in an R-1 (Single-Family Residence District
Regulations) zone district are required by Section 21.20.110
of the Palo Alto Municipal Code to have a depth of 100 feet and
the proposed lots fail to have this depth; and
WHEREAS, the depth stated above requires exceptions from
said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
condit~.cns affecting the lots, including the fact that both
parcels substantially exceed minimum area requirements and
that the exceptions granted herein are necessary for the preser-
vation and enjoyment of a substantial property right of the pe-
titioner, and that the exceptions granted herein will not be
detrimental to the public welfare or injurious to other property
in the territory in which this property is situated.
SECTION 2. The City Council hereby approves the Miscellaneous
Division of Land for the subject property, as shown on the map
attached herein and incorporated herein by reference, and grants
the exceptions t.o the one hundred (100} foot depth requirement
as provided in Chapter 21.28 of the Palo Alto Municipal Code with
the following conditions:
a. The applicant grant the City a five (5} foot wide
utility easement along the southerly property line.
b. The gas and sewer service for 1060 Embarcadero
Road be relocated to that property at the applicant's expense.
c. Applicant construct a covered parking space on
Parcel 2.
d. The existing house that straddles the new property
line be removed.
SECTION 3. The City Council hereby finds that the proposed
project will not have a significant impact on ~he environment.
