HomeMy WebLinkAboutRESO 5570• ORIGINAL RESOLUTION NO. 5570 PESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APr1ROVING THE MISCELLANEOUS DIVISION OF LAND AT 1945 COWPER/1944 TASSO ~.ND GRANTING AN EXCEPTION WHEREAS, 16,600 square feet of property zoned R-1 and located at 1945 Cowper/1944 Tasso in the City of Palo Alto, hereinafter referred to as the "Subject Propertyn is proposed to be re-divided into two (2) lots; and WHEREAS, lots in an R-1 (Single-Family Resider,ce District Regulations) zone district are required by Section 21.20.110 of the Palo Alto Municipal Code to have a depth of 100 feet and one of the proposed lots fails to have this depth; and WHEREAS, the proposed division of land requires an exception from said requirements; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION l. The City Council finds that there are special conditions affecting the lots, including the facts that two lots presently exist and tha~ both new lots exceed minimum lot area and that the exception granted herein are necessary for the pre- servation and enjoyment of a substantial property right of L~e petitioner, and that the exception granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this property is situated. SECTION 2. The Ci~y Council hereby approves the Miscellaneous Division of Land for the subject property, as shown on the map r attached hereto and incorporated herein by reference, and grants the exception to the one hundred (100) foot depth requirement as provided in Cha~ter 21.28 of the Palo Alto Municipal Code. SECTION 3. The City Council hereby finds that the proposed project will not have a significant impact on the environment.
