RESOLUTION NO. 5569
RESOLUTION OF TUE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE MISCELLANEOUS DIVISION OF LAND AT
1333 TASSO STREET AND GRANTING AN EXCEPTION SUBJECT
TO CONDITION
WHEREAS, 11,250 square feet of property zoned R-1 and located
at 1333 Tasso Street in the City of Palo, hereinafter referred to
as the "Subject Property" is proposed to be divided into two
(2) lots; and
WHEREAS, lots in an R-l (Single-Family Residence District
Regulations) zone district are required by Section 21.20.110
of the Palo Alto !iunicipal Code to have a width of 60 feet
and an area of 6,000 square feet and the proposed lots fail
to have this depth and area; and
WHEREAS, the depth and area stated above require exceptions
from said requirements;
NOW, THEREFORE, the Council of the City of Palo Alto
does RESOLVE as follows:
SECTION 1. The City Council finds that there are special
condit!Ons affecting the lots, including the fact that the
existence of other parcels of t..~e same dimensions immediately
adjacent to this parcel is a special circumstance affecting
this property1 and that the exceptio,.,s granted herein are
necessary for the preservation and enjoyment of a substantial
property right of the petitioner, and that the exceptions
granted herein will not be detrimental to the public welfare
or injurious to other property in the territory in which this
property is situated because the propose·d lots are consistent
in size with the present land use pattern.
SECTION 2. The City Council hereby approves the Mis-
cellaneous Division of-Land for the subject property, as
~,shown on the map attached hereto and incorporated herein by
reference, and grants the exceptions to the one hundred (100}
f~ot depth and 6,000 square foot area requirements as provided
in Chapter 21.28 of the Palo Alto Municipal Code with the
condition that the trellis extending over the new property
line be removed, and approves the location of the existing
building on Parcel 2 and the variance from the side yard setback
requirements requi. r-ed thereby •
SECTION 3. The City Council hereby finds that the proposed
project will not have a significant impact on the environment.
