RESOLUTION NO. 5559
RESOLUTION OF THE COUNCIL OF THE CITY OF PAL) ALTO
APPROVING 'l'HE MISCELLANEOUS DIVISION OF LAND 1.T
4339 EL CAMINO REAL AND GRANTING EXCEPTIONS
WHEREAS, 4.59 acres of property zoned P-C and C-3-5 and located
at 4339 El Camino Real in the City of Palo Alto, hereinafter
·referred to as the "Subject Property11 is proposed to be divided into
three lots; and
WHEREAS, lots are required to have 60-foot side frontage on a
public street, and one of the proposed lots (Parcel 2) does not have
the required frontage; and
WHEREAS, Section 21.32.020 of the Palo Alto Municipal Code
requires that miscellaneous divisions cf land which create parcels
exceeding two acres must be-approved by the City Council and one of
the parcels . (Parcel 2) exceeds two acres; and
WHEREAS, the lot without the required frontage and the lot ex-
ceeding two acres require exceptions from said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SEC..'TION 1. The City council finds that there are special r.on-
ditions affecting the lots, including the fact that Parcel 2 is only
five feet short of having the required frontage and that portion of
Parcel 2 fronting on El Camino Real is proposed for dedication as a
public street under existing P-C zoning and that the exceptions
granted herein are necessary for the preservation and enjoyment -of a
substanti~l property right of the petitioner, and that the excep-
tions granted herein will not be detrimental to the public welfare
or injurious to other property in the territory in which this prop-
erty i~ situated. ,
SEcrION 2. The City Council hereby approves the Kiscellaneous
Division of Land· for the subject property, as shown on the map
attached hereto and incorporated herein by reference, and grants th6
exceptions to the 60-foot frontage requirement as provided in
Chapter 21.32.050 of the Palo Alto Municipal Code, with the fol-
lowing ~onditions;
l. The applicant post a bend for construction of the parking
required under Section 2.B.6. of Ordinance 30361
2. Access easements be granted and shown on the final map
over Parcel 2 for the benefit of Parcels 1 and 3; and
3. The owner of Parcel 2 enter into contractual arrangements
satisfactory to the City Attorney to guarantee continued
availability of parking on the 11 leq" portion of Parcel 2
for the benefit of Parcels 1 and 3 until str~et construc-
tion begins.

SECTION 3. The City Council hereby finds that the proposed
project will not have a significant impact on t!,e environment.
