HomeMy WebLinkAboutRESO 5546• RESOLUTION NO. 5546 ORIGINAL .RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING ORDINANCE NO. 2830 TO MODIFY THE DEVELOPMENT SCHEDULE FOR THE P-C DISTRICT KNOWN AS 300 HOMER AVENUE, SUBJECT TO CONDITIONS The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. Section 3, of Ordinance No. 2830 adopted December 9, 1974,is hereby amended to read as follows: a. Construc.tion shall commence within 18 months of City Council approval. b. All construction and improvements shall be completed by May 19, 1982. SECTION 2. All other provisions of Ordinance No. 2830 shall remain in full force and effect as originally adopted. Substitute the following: "The 1978 zoning ordinance further reduces the extent of non-conforming uses and non-complying structures by allowing continued, unamortized use and occupancy by existing multi-family uses and structures in the single-family and duplex zones in accord with Housing Policy #2 of this Plan; and by allowinq continued, unamo?.tized use and occupancy by off ices in multi- family zones which were lawfully existing in multi· family zones under the previous ordinance, in ac~ord with Einployment PrograJD 4 and the text on page 18 of this Plan. •To go one step f1.i.rther in preserving compatible existing uses, a new procedure will be developed ·whereby owners of improved prope~ies other than those described above, and which have become non- conforming by application ·of the 1978 zoning ordinance, may apply to be excepted from the termination provisions for non-canforming uses by action of the Planning Commission and City Council. Each applicant will be required to demonstrate that the present use is ~ compatible with those uses that are consistent with land use desiqnations. once excepted from the termination provisions, such a use will not be subject to amortization, and in addition,. the improvements on the property may be remodelled, ~roved, or replaced on the same site for continual use and occupancy by the same use, providet' · that there will be no change of the use or increase in the size of the improvement.• • SECI.'ION 3. The City Council hereby finds that the adoption of those amend.luents to be Palo Alto ComprehensiV'e Plan set forth in paragraph 2 hereof will not cause ~Y significant environmental ~acts.
