OF THE CI'IT OF PALO ALTO -APPROVING THE MISCELLANEOUS DIVISION OF LAND AT 265 LYTTON AND 360 BRYANT AND GRANTING E..'CCEPTIONS ORIGINAL WHEREAS, .532 acres of property zoned C-2 and located at 265 Lytton and 360 Bryant in the City of Palo Alto, hereinafter referrec! to as the 11subject property" is proposed to be divided into two (2) lots; and WHEREAS, lots are re~uired by Section 21.20.110 of the Palo Alto Munici- pal-Code to have a depth of 100 feet and an area of 6,000 squa~e feet and one of the proposed lots fails to have this d~pth and area; and WEREAS, both the dC>pth and area stated above require exceptions fr .. -1 said requirements; NOW, THEREFORE, the Council of the City of Pa:i..o Alto does RESOLVE as follo\./s: SECTION 1. The City Co .. rncil finds that there are special conditions affecting the lots, incl~ding that there is cousiderable variation in the si?.e of commercially-zoned lots in the downto-.m area, and that the exceptions granted herein are necessary for the preservation_ and enjoyment of a subst&ntial pro- perty right of the petitioner, and that the exceptions granted herein will not be detrimental to the public welfare or injurious to ~ther property in the territory in which this property is situated. SECTION 2. The City Council hereby approves the Miscellaneous Division cf Land for the subject property, as shown on the map attached herein and incor- porated herein by reference, and grants the exceptions to the on~ hundred (100) foot depth and 6,000 squ3re foot area requiraments as provided in Chapter 21.28 of the Palo Alto Municipal Code, subject to the iollowin& conditions: 1. There be three-quarter hour protected openings on window3 and doors within 20 feet of the rear property line. SECTION 3.
