.U:SOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ESTABLISHING AN AGRICULTURAL. PRESERVE WITHIN THE
C!TY OF PALO ALTP AND AUTHORIZING THE EXECUTION OF
A LAND conSERVATION COUTRACT (JOHN P. CHAMBERS AND
LEILA G. HARBIN -SKYLINE BOULEVARD)
&tllGINAL
WiiEREAS, John P. Chambers and Leila G. Harbin are owners of
a certain parcel of land in the City of Palo Alto, Santa Clara
Colttlty, California; have applied to have such land designated an
agricultural preserve under the provisions of the Land Conservation
Act of 1965; and have submitted a contract executed by them, as
owners, acceptable to the City Council; and
WHEREAS> the City Council has received and reviewed the report
of the Director of Planning and Con:munity Environment concerning ,
the request to establish this preserve; hereby finds that the .
establishment of this preserve is consistent with the Comp1:ehensive
Plan of the City of Palo Alto; and further finds that the establish-
ment of this preserve {which includes an area of approximately
17.28 acres) is necessary due to the characteristics of the agri~
cu~tural enterprises in the area and that the establishment of a
preserve of such size is consistent with the Comprehensive Plan of
the City of Palo Alto for the following reasons: ·
1. Historically. agricultural and rural operations
tn the area have been conducted on comparatively small
holdings, and an imposition of a 100-acre size on ~gri
cultural preserves would unreasonably prevent the main-
tenance of land in an agricultural or rural status; and
2. The terrain is such that the appearance and sub-
stance of an agricultural or rural enviroument would be
maintained on parcels of less than 100 acres;
NOW, THEREFORE. the Council.of the City of Palo Alto does
, . RESOLVE as follows~
--SECTION 1. A Land Conservation Contract. a copy of which is
attached hereto, is incorporated by refe:rence herein; as though
fully set forth~ Sai,d contract hereby is a.ppruved, iind t:b.e Mayor
is authorized and directed to execute said contract.on behalf of
the City.
SECTION 2. Th.e area described in the document designated as
EXHIB!t "I" to said cono.;ract and as showii on the map e,ttached to
said contract hereby is designated and established ae an agri·
cultural pt:'eserve under the provisions of the Cal µorni.a Land ·
C~aervation Act of 1965 (''Williamson Act"). adopted by the City
C<'uncil.
S!CTION 3. The City Clerk is directed to perform any ~ct
neceasary !e~ the attestation of •aid contract, the filing of a
c~py of thia resolution and of said contract in the Office of the
County Recorder of the County of Santa Clara, a~d such other
filings and acts as are required by law. ·

This is an agreement between the CITY OF PALO ALTO, a municipal corporation o.' the

WHEREAS. Owner wssesses certain real property 10\:l!tcd within the City of Palo A.jto,
County vf Santa Clara, State of California, which is presently devoted to asricultural use and
is described in Exhibit B attached hereto and made a t>art hereof; ind ·
WHERE~. the property is located in an agricultural pte~-n't heretofore established by City;
and
WHEREAS, ooth Owner and C1t1 de!ire to limit the use of the property to qricultural
. and compatible uses; amd < t
-WHEREAS_ the parties have determined t.'iat the highe~t and best use for the. property during.
the term of this contract; or any reniewal thereof. shall be for qriculturaJ. and compatt"ble uses. .

Part t, Divi$ion 1, Title $ of the Govemm~t Code, whicll is known ii the Califoniia Land
Ccnserntion 1Let of 1965, hereinafter called." Act:" This contract is su~ct to an of the rrovisions
of the Act and City Ordinance No. ;J ''J including any· amendtaents thereto which may
hereafter be enacted. The provisions of die Act are ineo.rpOrated herein. by this reference. Owner
declares that he has recei:ved from City a copy of the Act, as amended in l 971, relevant aections
of the Revenue and Taxation Code. u amended µi 1971, and Artid~ XXVUI of the California
Constitution; and dlat ht has read and understantts the provisions thereof.
2. RESTRICTION ON USE OF PROPERTY.
Durlna ~ term of this contract. and any and aD renewals ~. the propCrty descnDed
in Bxlu'"bit B shall not be used by Owner, or OW:aer's succ:usors· in Interest, for any use other
than those agricultural UleS and oompatible uses· which arc detmnined by· the Council of the
CJty of Palo Alto as the qriculturil and compatil>le uses permitted in the preserve in which
the land is located. A list of all such compatJ'l)le uses is &et fort.'1 in Exhibit A, attadied heretl> ·
and by-this reference incorpQrated herein. City. by uniform JUle adJpted t>y. ~City Council,
may from time to time during the term . of this contract and all renewals thereof, add ~o the -
list of compatible uses which shall ·be unifonn throupout the aarfcultural presen-~ ~ which the
... property in Exhibit Bis located; provided, however, City may not durin& the tcnn of um contract
or any renewal thereof, without the prior written consent or Owntt, rcmOYe any of the compatible

3,. TERM OF CONTRACT.

4. NonCE OF NONRENEWAL.
(a) If either party desires in any year ft()l to renew this c::ontract, that party shall serve
written notice of nonrenewa! upon the other party in advance of the annual renewal date of
tbiJ c:ontnct. Unless such written notice of nonrmeWal is served by 0wna at le.ast 90 days
prior to the renewal date, or by City at_ least 60 days prior to the renewal date, this ccntract
lhlJl be considered renewed u proWled in paragraph 3 above. .
{b) If dtber party serves written nOtice of r.onrenewal in any year wjthin the time limits
of 4(1} aboni, thit contract shall remain in effect for the balance of the period remaining since

Owner shall not recetve any payment from City in considerat!on of the obligations imposed
