RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE PRELIMINARY PARCEL M..~ FOR PROPERTY
LOCATED AT 211 MELVILLE AVENUE, .AND GPANTING
EXCEPTIONS SUBJECT TO CONDITIONS
WHEREAS, 15,000 square feet of property zoned R-l-B-10
(Single-Family Residence District Regulations-Special Building
Site District Regulations) located a~ 211 Melville Avenue,
hereinafter referred to as the "Subject Property" is propl)sed
to relocate the existing lot line to create two lots of different
configuration than tile two existing lots1 and
WHEREAS, Subject Property is required by Sect.ion 21. 20 .110
of the Palo Alto Municipal Code to have not le~s than 10,000
square feet for each lot where 7 ,500 square fe•.!t for each
lot is proposed; and
WHE~, subject property is required by Section 18.12.090
of the Palo Alto Municipal Code to have a rear setback of
twenty (20) feet where 11.6 feet is proposed.
NOW, THEREFORE, ~Jl9 Council of the City of Palo Alto does
!ll:SOLVE as follows·:
SECTION 1. The City Council finds that there are special
conditions affecting Subject Property due to the existing
substandard parcels. The proposed change in lot line would
create two parcels of simiiar substandard size and different
configuration but would preserve several trGe.s located on
subject property·and with the possibility of a second dwelling
being constructed, that the exceptions granted herein are
necessary for the preservation and enjoyment of a substantial
property right of the petitioner; .and that the exceptions
will not be detrimental to the public weliare or injurious
to other property in the territory ;.n which this property
is situated.
SECTION 2. The City Council hereby approves the pre-
liminary parcel map for the Subject Property, as shown on
the map attached hereto and incorporated herein by reference;
and grants the except~~ns to the requirements of Title 21
uf the Palo Alto Municipal Code, subject to the following
conditions:
a. A covered parking space for the exist~~g residence
must be provided:
bs Should the existing garage remain, it must have a
one-hour fire wall installed w~thin three (3) feet
of th~·-'. property line.
c. Requirements of ·city Utilities Department regarding
gas and sewer lines must b$ complied with.
SECTION. 3. The City council hereby finds the propoPed
project wii!"'not have a significant impact on the environment.
