A RESOLUTION CALLING FOR SEALED PROPOSALS
AND FIXING LIQUIDATED DAMAGES FOR FAILURE
TO COMI·LE'l'E THE WORR WITHIN TIME SPECIFIED
PROJECT NO. 74-65
S~~D RILL ROAD (PORMBRLY WILLOW ROAD)
RESOLVED, bi the Council of the City of Palo Alto, Santa Clara
county, California~ that:
WHEREAS, the said Council did, on the 2ls_t day of March; 1977,
adopt its Resolution,·No. 5370 of Preliminary Determination and of
Intention to order the construction of
(a) The widening and improving of Sand Bill Road from Santa
Cruz Avenue to.its northeasterly terminus, and Willow Road frOl'll said
terminu~ of Sand Bill &oad no~theasterly to Arboretum Road, by
grading and the construc~ion therein of a four-lane road section,
64-feet wide, located within a 90-foot riqht of way, with a .
landscaped median strip, and by co~structinq therein base paveaerit,
wearing surface, curbs, gutters, &_tor• drainage facilitles,-street
lighting facilities a~d-landscaping improveaents, with bicycle paths
between the edge of curb and the right of way line, and
(b) The widening and· improving of Willow Road froa ArbotetUJI _
Road north~asterly to El Camino Real by grading and the construc~ion
therein of base pavement, wearing surface, draina9~ facilities as
required, street lighting facilities and landscaping improvement,
-~-!-t as more particularly' described and set forth in said liesolution
~~ Preliminary Determination and of Intention:
NOW, THERBFOR.E, the City Clerk of said City is.hereby directed
to publish once • week for two weeks in the Palo Alto Tiaes, a
newspaper published and circulated in said City, a notice inviting
sealed proposals or i:>ids for the construction of said iJIPX'OVeAle_litS,
and referring to the plans and specifications on file in th~ Office
of said City Clerk, the first publication of which notice shall be
a~ least fourteen days prior to. the-time fixed fo.: openl119 bids.
Bidder may obtain a ·copy of the plans, s~cifications, and
other eont:ract documents froa the Off ice of the City Engineer of the
City of Palo Alto,-Civic Center, 250 Hamilton Avenue, Palo Alto,
California, without charge and reference is made thereto for
particulars. Additional copies ot the plans, specifications, and.
other contract documents may be purchased from said off ice for the
non-refundable charge of forty-Two Doll'-rs and forty cents ($42. 40) r.-•
tax inuluded, and sh~ll. becoae the property of the purchaser. Make.:-
ch•cks payable to· the City of Palo Alto.
Pursuant to Section 1773 of the Labor Code of the State of
California, the City has obcained ftOll the Director of the
Departaent of Industrial Relations the Cjieneral prevailing rate of
per diem wages and the general pt'evailirig rate for holidays and
overtiae work for each craft, claealf icatlon, or type of workJl~n
required to execute the contract. A copy of said prevailing rate of

per diem wages is on f lle in the office cf the Director of
Purchasing Service•, to which reference is hereby made for further
particulars. Said prevailin9 rate of per die• wages will be made
available to any interested party upon request, and a copy thereof
shall be posted at the-job •ite. 'l'he provisions of Art_icle 2,
Chapter 1, Part 7, Division 2 (commencing with Section-1770) of the
Labor Code and particularly Section 1775 thereof, shall be complierl
with.
All ~roposals or bids shall be accompanied by cash, a
cashier's or certified check payable to the order of the City Clerk
amounting to ten percent of the bid, or by a bond in said amount and
payable to said Clerk signed by the bidder and a co:rporate surety,
or by the bidJer and two sureties, who shall justify before any
off leer competent to administer an oath, in double said amount and
over and above all statutory exeaptions. The amount so posted shall
be forfeited to said City in case the bidder depositir.g the same
does not, within fifteen days after written notice that the contract
has been_ ~warded to hi•, enter into a contract with the City.
It is hereby deterained that ln the event the contractor,
contracting owners included, dOes not complete the wark within the
ti•e limit specified in the proposed contract or within such further
time as this Council shall have aut~~rized, the cont~actor or
contracting owner3, as the case may be, shall pay to the City
liquidated da~ages in the 4lllOUnt of One Thousand Dollars ($1,000.00)
per day for each a~d every day~s delay in finishing the work beyond ·
the completion dat~ specif led in said contract. Additional
provisions with regard to said time of coapletion and liquidated
damages are set forth in the specifications, which provisions are
hereby referred to and inc_Qrporated herein by reference.
Said sealed proposals or bids shall be delivered to the
Director of Purchasing Services of said City·-on or before 3:00
o'clock p.a. on Wedne~day, the lst day of March, 1978, sai~ tiae
being at lee.st fourteen days from the time of the.first publl<:ation
of said notice. Bids will be publicly opened, examined and declared
on said day _~nd hour, and ref_erred to and con~ideted by the Council
at its aeeting at 7:30 <>'clock p.a. on H•rch 13, 1978.
