A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST Al~D
NECESSITY REQUIRE 'I'HE ACQ'Jil.tTION OF CERTAIN LANDS AND
DIRECTING THE FIL~NG OF EMINENT DOMAIN PROCEEDINGS
SANu HILL ROAD (FORMERLY WILLOW ROAD)
PROJECT NO. 74-65
RESOLVED, by the Council of the City of Palo Alto, California,
WHEREAS, it is ne~essary and desirable for the City of P~lo
Alto to acquire that certain real property more particularly ·-
described in Exhibit "A" attached hereto and by this reference made
a part hereof, for the purpose of constructinq, operating and
maintaining streets and utility facilitie~ in connection with the
Sand Hill Road (formerly Willow Road), Project No. 74-65, as
~P,scribed in ~esolution of Preliminary Determination and of
Intention No. 5370, adopted by said C6uncil on MRrch 21, 1.977,
hereinafter referred ta as "the Project":
WHEREAS, notice has been duly given pursuant to the pro~isions
of Section 1245.235 of the Code of Civil Procedure of the State of
California, and all persons whose property is to be acquired by
eminent domain ar.d whose name ~nd address appear en the last
equalized county assessment roll 'have been given a reasouable
opportunity to appear and be heard before -~he Council of the City of
Palo Alto on the following matters, to ~it:
(al Whether the public interest and necessity require the
Sand Hill Road (formerly w,;,}~low Road),-· Project 74-651 .
(b) Whether the Project is planned or located in th~ manner
that will be most compatible with the greatest public good and th•:.
least private injury~
{c) Whether the.property snu9hL to be acquired is necessary
for the Project; and
WHEREAS, th'-0' City of Palo Alto is vested with the power of
eminent domaihc -t..0 acquire real or personal property by virtue of
Article 2 of th.~ Ch~rter of the City of Paln Al to, Section ,1;-3 .12. 040
of the Palo Alta Municipal Code!, Sections 37350.5 and 37353 of the .
Government Code of the State of California, and Article 1, Section·
19 of the Constitution of th~ State of California.
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as
follows: ; ,·
1. The public inter~st and necessity require the Project;
comprised of the acquisition, construction, completion, maintenance
and operation of street and utility facilities in, over, across and
upon the parcels of land more particularly described in said Exhibit
·A~, and the taking of the fee simple title in and to the parcel of
land mo~e particularly de·scribed as ~cquisition Parcels D-2 and G in
said Exhibit "A" and the taking of an easement i·n the parcels of
land more particularly described as Acqnisition Parcels A, B, c,
D-1, ~ and l and as Acquisition Easements Nos. A-A, B-B, c~c, D-D, ·
B-E, F-F and G-~ in said E~hibit •A•, for· such purposes, are
necessary for said Project.

will be most compatible with the greatest public goor. and the le3st

3. The City Attorney and the law firm of Wilson, Jones,
Morton & Lynch, special ~ounsel f.or the City, be and they are hereby
directed to institute and conduct to conclusion an action in e~inent
domain for the acquisition of the esta·es and interests aforesaid--
and to take such action as i$ necessary therein, and said law firm
of Wilson, Jones, Morton & Lynch shall be paid a reaso~able fee
therefor.
