HomeMy WebLinkAboutRESO 5504• ~ -.. -lo • 027CA-22a • WJML:KIJ:shw 12/13/77 ORIGINAL RESOLUTION NO. 5504 A RESOLUTION ORDERING THE VACATION OF FUTURE RESIDUi\L STREET RIGHTS OF WAY SAND RILL ROAD (FORMERLY WILLOW ROAD) PROJECT NO. 74-65 RESOLVED, by the Council of the City of Palo Alto, Califotnia, and this Council does hereby find, determine and order as follows: 1. That said Council did on the 21st day of November, 1977, adopt Resolution No. 5482, "A R~~-<:>lution of Intention to Vacate Future Residual Street Rights of. Hay Along Willow Road (Sand Hill Road)•, wherein the Council expressed its intention to order the vacation of said residual street rights of way more particularly described in Exhibit •A• hereto attached and by reference made a part hereof. · · _ . 2. That said Resolution recited that said proceedings were · Wing undertaken under and pursuant to Part 3 (cOJM1encin9 with Section 8300) of Division 9 of the Streets and Highways Code of the State of Califo~nia, a~d did further determine and dec~are that in ·the opinion of said council the public interest and conve~ience ~required s~ch vacation. 3. That said Resolution was duly posted ~nd notices of its passage, entitled •Notice of Proposed Street vacation• were duly posted in the time, •anner and form provided by law, all as appears frca the affidavit of posting on file in the office of the Clerk of said City. 4. That Monday, the 19th day of December, 1977, at the hour of 7:30 p.m. at the Council Chambers o! the Council of said City, Ci\•ic Center, 250 Hamilton Avenue, Palo Alto, California, was fixed in s11id resolution as the time and place when and where any and all persons interested in, or objecting to, said proposed vacatio~ aight appear before said Council and show cause why the Council should not otder said v~catlon in accordance with said Resolution and th~ law in the premises. ~s". That said hear :tng was duly held at the time and in the place s~ated in paragraph 4 hereof. ·- 6. That all interested persons were heard and were aade or filed against said proposed vacation. objections· 7. T~at said residual gtreet·~ights of way de~cribed in Exhibit •A• is unnecessary for public street purposes. 8. That -the residual s~reet rights of way described in Exhibit MA" are h~reby vac~ted reserving and excepting, however, from the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across said residual street rights of way proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew an~ enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and ~cod growth, and otherwise protect the same from all hazards in, upon and over the residual street rights of way proposed to be vacated. 9. That the City Clerk of the City of Pale Alto Ghall cause a certified copy of this Resolufion to be recorded in the off ice of the County Recorder of the County o~ Santa Clara pursuant to the provisions of Section 8324 of the Streets and Highways Code of the State of California.
