RESOLVED, by the Council of the City of Palo Alto, Califo_rnia,
that the City Treasurer of said City be, and he is hereby,
a;ppointed Collection Officer and the person to whoa payment of
assessments shall be made unddr Resolution Ho. 5370 of Prelbaina:r:y

things pertaining to said acquisitions _and iaproveaenta were fully
heard and considered by said Council, and were overruled and aald
Council has acquired jurisdiction to order said acquisitions and
improvements and th€ '=onfirmation of said Bngineer's Report,
NOW, TBER.BPORB, said Council does hereby FIND, D8'1'BRMINB and-
ORDBR, as follows:
1. That the owners of one-half of the area of the property to
be aaaesaed for the cost of s~ld project did not, at or prior to the
tiae fixed for said hearing, file written protests against said
acquisitions and imprqvements, or as to the Engineer's estimate of
costs and expenses of · .... aid project, or against the grades at which
said work is proposed to be done, or against the aaps and
descriptions. ·
2. That any and all protests made either to said proposed
acquisitions and improvements, or the grades at which said work ia
proposed to-be done, or the extent of the assessment district, or
the aeps ?..&id descriptions; and all persona desiring to be heard in
relation to any of said aatters, whether as protestants or
otherwise, have been fully heatd and co~sjdered, and have been.
overruled.
3. That the district benafited by said acquisitions and
improve•ents and.to be assessed to pay the costa and expe~aea
thereof, and tbe exterior boundaries thereof are aore particularly
described in said P.esolution of Intention and aade a part hereof by
reference thereto. That all public streets and highways within said
asaesS11ent district in use in the performance of a public function
as such shall be omitted frt111 said district and froa the levy and .
collection of the special tazes to be hereafter levied and co~lected
to cover the costs and expenses of said acquisitions and
i11Proveaents~
4. That the plans and specifications for the pr6posed
i11Prov .. ents, contained in said report, be, and they are hereby,
finally adopted and approved as the plans and specif icationa to
which said work shall be done as called for in said Resolution of
Inter.tion.
s. That the Bngineer•a estiaate of the lt.aized and total
costs and expenses of said acquisitions and iaprove11ents, and of the
incidental expenses in connection therewith, con~ained .in said
report, be, and it is hereby, finally adopted and approved a~ th~
Bn9ineer•a total and detailed estiaate of the ~ata and expenses of
said acquisitions and i11Prov9119nts. ·
6. That the maps and descript!ona of the lanGs &nd easeaents
to be acquired, as contained in said report, be, and the am1e are
hereby, fjnally approved and confiraed. -
7. That the public intere·st and convenience require, and said
council does hereby order the ·acquialtiona and l11Prov ... nta to be ·
aade as deacribefi in and in 1".ccordance with aaid Re50lution of,_.
Prelialnary Determination and of Intention on file in the of/ice Qf
the City Clerk of said City, reference to vbich i• hereby aade for a

8. ··That the dtaqr~11 showing the asaeaament district referred
to and described in aaid Resolution of Intention, and also the
boundaries and dimensions of the respective subdivlaioraa of ·1and
within said district as the same existed at the tiae of the passage
of said aeaolution of Pr.eliminary Determination and of Intent'.ion,
each of which subdivisions having been given a separate nuaber upon
said diagram, as contained in s~id report, be, and it is hereby,
finally approved and confirmed as the diagram of the properties to
be assessed to pay the costs and expenses of said acquiaitiona and
improvements.
9. ~hat the assessment of the total amount of the coats and
expenses of the proposed acquisitions and iaprovementa upon the
several subdivisions of lan~ in said district in proportion to the
estiaated benefits to be received by said subdiviaions,
respectively, frOll said acquisitions and improvements, and of the
expenses incidental thereto, contained in said report, be, and the
sa•e in hereby finally approved and confiraed aa the asaeasaent to
pay the coats and expenses of said acquisitions and iaproveaents.
10. That said Bngineer•s Report-be, and the .aame is hereby,
finally adopted and approved as a whole.
11. That the City Clark shall forthwith deliver to the
Superintendent of Streets the said ! •. "f!S&aent, together with sat.a
diagram thereto attached and made a ·.-.. rt thereof, as confiraed by
this Council, with her certificate of such eonfiraation .thereto
attached and of the date thereof 1 and that said Superintendent of
Streets shall record said dlagraa and aases311ent in his off ice in a
suitable book to be·-kept for that purpose, and append thereto bis
certificate of tbe date of such recording, and such recordation
shall be and constitute the assesaaent roll herein.

12. That the Collection Officer, upon the recording of said
diagraa and assea .. ent, shall cause to be mailed to each ovn4r of
real property within the assessment district at his last known
address as the smae ~ppears on the tax rolls of the City or on file
in the office of the City Clerk.~i said C~ty, or to both addresses
if said address is not the same, :.>r to th<! general delivery when no . ,
address so appears, a stateaent containing a desi9m..t~on by street
nUllber or otber desctiption of. the property asResaed sufficient to
enable the owner to· identify the same, the amount of the assessment,
the date of recordation of the asaeasaent, the time and place of
payaent thereof and the effect of failure to pay within such tiae,
together with a atate11ent of the fact that bonds will be issued on
tbe unpaid aaaee .. enta pursuant to the lJIProv ... nt Bond Act of 1915.
13. That said collection Officer shall also cause Notice to
Pay AaaesS11ents to be publia~ed in the Palo Alto Times, a newspaper
published and circulated in said City, that said asaesSJ1ent has been
recorded and that all auaa assessed thereon are due and payable
immediately and that the payaent of said ... is to bt!·111ade wt.thin
thirty (·30) days after the date of reccrding said aaaessaent, which
date shall be stated in said n?tice,'tbe effect f>f the failure to
pay aaseasaenta "'t.izln the ·30 d•y period,. and of ·tbe fact that bonds
will be issued upon unpaid assessments as above provided. Said
publication aball be aade once a week for two eucceaslve weeks with
at least five daya i~tervening between the r~~pective publication
