RESOLUTION OF THE COUNCIL OF THR CITY OF PALO AL~O
APPROVING THE MISCELI·ANEOUS DIVISION OF LAND AT
195 NORTH CALIFORNIA AVENUE Al~D GRANTING EXCEPTIONS
WHEREAS 11,378.S square feet of property zoned ~-l and located I
at 195 North California A~enue in the City of ralc Alto, hereinafter
referred to ~,~ thA "subject property 11 is proposed to be divided
into two (2} lots; and
WHEREAS, lots in an R-1 zone district are required by Section
2l.2G.110 of the Palo Alto Muni~ipal Code to have a depth of 100
feet and an area of 6,000 square feet and the proposed lots fail
to have this depth and area: and
WH~REAS, both the depth and area stated above require ex-
ceptions from said requirements;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION l. The City Council finds that there are special
conditions affecting tre lots, including the present area of the
existing lot which is substantially in excess of that required,
and that the exce~tions granted herein are necessary for the pre-
servation and enjoyment of a substantial property right of the
petitioner, and that the exceptions granted herein will not be
detrimental to the public welfare or injurious to other property
in the territory in which this property is situated.
SECTION 2. The City Council hereby approves the Miscellaneous
Division of Land for the subject property, as shown on the map
attached herein and incorporated herein by reference, and grants
tlie exceptions to the one hundred (100) foot depth and 6,000 square
foot area -requirements as provided in Chapter· 21.28 of the Palo
Alto Municipal Code, subject to the following conditions:
1. The portion of the garage extending into new Parcel 2 be
removed and a one-hour fire wall be constructed on the side of
the garage abutting the new lot line; and
2. No variances be granted in the future for buildings on
either of the two parcels.
SECTION 3. The City Council hereby finds that the proposed
project will not have sig~iff ~ant impact ~n the tinvironment.
