HomeMy WebLinkAboutRESO 5442., RESOLUTIOU HO, 5442 u1<.IGINAL RESOLUTION OF·THE COUUCIL OF THE'CITY.OF PALO ALTO APPROVIUG A MISCELLAUEOUS OIVISIOH OF LA.HD FOR PROPERTY LOCATED ON LOS TRANCOS ROAD NEAR ALPINE ROAD IN THE CITY OF PALO ALTO AND GRANTIHG EXCEPTIONS FOR LOT AREA ON ONE PARCEL,. AND FOR ROAD FRONTAGE ON TWO PARCELS, SUBJECT TO CONDITIONS wHEREAs, 29.44 acres of property zoned 0-S located on the east- erly side of Los Trancos Road approximately one-half mile from its intersection with Alpine Road in the City of Palo Alto, beinf a por- tion of Rancho El Corte de Madera and identified as Assessor s Parcel No .. ·:.82-36-009, hereinafter referred to as· the "subject property," is proposed to be divided into three parcels; and WHEREAS, the proposal will create three parcels, Lot 1 and Lot 2 consisting of 10 acres each and Lot 3 consisting of 9.4 acres; and · WHEREAS, Lot 3 is a rear lot which is required by Section 21.32.0SO(b).of the Palo Alto Municipal Code to have an area which exceeds the 10-acre lot area requirement of the 0-S District by 20 percent exclusive of any access to a public street; and WHEREAS. Lot 3 ther~fore is substand8rd in area by 0.6 acres Wider 0-S District regulations, and by 2.6 acres under rear lot regulations. requiring an exception from the requirements of Section 21.32.050(b) of the Palo Alto Municipal Code; and WHEQAS, Lot 2 and Lot 3 do not have frontage on a public street as required by Section 21.32,0SO(c) of the Palo Alto Municipal Code; NOW, THEREFORE, the Council of the City of ·Palo Alto does RESOLVE as follows~ SECTION 1. The Council finds that thet./e are special conditions affecting tots 2 and 3 due to the dimensions and geometry of tjle parcels; that the exceptions granted hereiii are necessary for the preservation and enjoyment of:::a substantial property right of the p~titioner; and that the exceptions granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this.property is situated. · SECTION 2. The Council hereby approves a miscellaneous .division of land into three parcels~ designated as Lot 1, Lot 2. and Lot 3, for the subject property, as shown on the map attached hereto and incor- porated herein by reference, and grants the exception to the area requirements of Sections 21.32.0SO(b) and 18,71.070 of the Palo Alto Municipal Code for Lot 3 and the exception to the street frontage requirements of Section 21.32.0SO(c) for Lots 2 and 3, subject to the following conditions~ (1) Access from Los_Trancos Road must be capable of supporting 33,000 pounds of fire apparatus during all weather, must have a 20-foot all-weather surface. must have a clear 13-foot overhead clearance, must have an incline not in excess of 15 percent; and must meet the vertical a~<t~-Q~izontal curves established for fire apparattis .. The road improvements shall be· installed prior to.City approval of the parcel map,. or an agreeul$nt shall be . executed arid a bond .shall be posted by the_ subdivider, in the·amount to be determined by the City, prior to City approval of the parcel map, to ensure completion of road improvements. (2) Prior to City approval of the parcel ma~, the subdivider shall execute an agreement, sub~ect to appi;:o~al b~.· the .. ". . •. --. • City Attorney, for continual maintenance of the private accea1 road in the subdivision to the standards required by the Palo Alto Fire Department. Such agreement shall be recorded and shall run with the land. (3) The owners of all lots shall have non-exclµsive right of ingress &nd egress along the proposed access road. (4)-The developer shall provide-for drainage along the pro- posed 20-foot road within the subject property subject to the approval of the City Engineer. _ (5) (6) (7) (8) (9) (10) (11) (12) - Cut and fill slopes shall not exceed one and one-half horizontal to one vertical. All slopes shall be pro- tected with native plants to prevent erosion. Each parcel in the subdivision shall be required to have an adequate on•site domestic and emergency water supply system designed to meet all applicable City codes and design specifications. To this end1 the subdivider shall be responsible for installing a 611 public water main to each lot. A 20-foot wide p~blic utility easement to acco~date t.his wateT line shall b~ granted to the City on tHe parcel map. Fu~thermore, the subdivider shall be· responsible for i~stalling fire hydrants at each lot. Design of the water line and placement of hydrants is subject to approval by· the City. The water line and hydrants shall be installed prior to City approval of the final parcel map or E!.11 agreement shall be executed and a bond spall be posted by the subdivider, in the amcnmt to be determined by the City, prior to City approval of the final parcel map, to ensure completi.on of these improvements, · . The developer shall pay all extension charges to each parcel to Pacific Gas and Electric Company unless Pacific Gas and Electric Company refuses to serve. -Then the developer shall pay extension charges per City S.(!bedule E-5. Internal subdivision utility lines shall be underground·. · The developer shal·l· .. a.pply to and obtain approval from the County of Santa Clara Health Department for septic systems installations. prior to approval of final map. A preliminary soils report shall be submitted prior to approval of the final map,. .which report shall, as a minimum, satisfy the standards set out in Section 18. 71.140 of the Palo Alto Municipal Code. · The developer shall: submit an offer of dedication tO the City of Palo.Alto for road purposes a strip of land 40 feet wide lying equally on each side of the existing centerline of Los .Trancos Road .as such road or any part thereof falls within the lil!lits of· the subject property to the sa~isfaction of the Dtrector of Public Works. The access road mus: be flared at Los Tran.cos Road· to provide"a sight distance of approximately 200 feet in each direction. No building permits shall be issued until all ~be above conditions have been met and the final map has been approved and recorded. SECTION 3.
