-RESOLUTION OF THE COUNCIL OF THE CI'l'Y OF PALO ALTO
DESIGNATING CITY ENFORCEMENT AGENCIES UNDEU THE
SOLID WAS~E CONTROL ACT OF 1976 AND REPEALING
RESOLUTION NO. 5431
WHEREAS, the County of Santa Clara and its incorporated
cities are required by Section 66796 of the Government Code to
designate enforcement agencies to carry out the provisions of
the Z'Berg-Kapiloff Solid Waste Control Act of 1976; and
WHERFAS, the County and each city wi~in the County of
Santa Clara has designated or will designate its own enforce-
ment agency(ies); and
WHEREAS, the County of Santa Clara, Environmental Manage-
ment Agency, Environmental Health Services is ideally suited to
serve as the City Enforcement Agency for health related regula-
tions of the Act; and
WHEREAS, the enforcement agency designated by the City of
Palo Alto for non-health related regulations possesses the re-
quired capabilities in solid waste management to implement the
Z4 Berg'Kapiloff Solid waste Control Act of 1976 and the regula-
tions and ordinances that have been and will be adopted pursuant
thereto; and
WHEREAs, the enforcement agency designated by the City of
Palo Alto for non-health related regulations has been given
sufficient personnel and an adequate budget to carry out the
enforcement program specified by law'
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. Resolution No. 5431 is hereby repealed.
SECTION 2. Pursuant to subsection (a) (3) of Section 66796
of the Government Code, the council of the City of Palo Alto
hereby designates the City Manager as the enforcement agency_-
for the City of Palo Alto for non-health related regulations of
the Solid Waste Control Act of 1976.
SEC~ION 3. T"ne Council of the City of Palo Alto hereby
designates the County of sa11.ta Clara, Environmental Management
Agency, Environmental Health Services as the enforcement agency
for the City of Palo Alto for health related regulations of
tile Solid Waste Control Act of 1976.

SECTION 4. The Council of the City of Palo Alto hereby
find• that fhe enactment of_ this resolution is not a •project"
within the meaning of that term as defined in Section 11.04.130
of tlle Palo Alto Municipal Code and, therefore, no environmental
assessment is necesaary.
