DESIGNATING CITY ENFORCEMENT AGENCY UNDER. THE SOLID
WASTE CONTllOL ACT OP 1976
WHEllEAS, the County of Santa Clara and its incorporated
cities are required by Section 66796 to the Government Code to
designate an enforcement agency to c,rry out the provisions of the Z•Berg-&apiloff Solid Waste Control Act of 1976; and
WHEREAS, the County and each cify within the County of
Santa Clara bas designated er will designate its own enforcement
agency(ies); and . ·
WHEREAS, the enforcement agency designated by the City o~
Palo Alto posaeeaes the required capabilities in enviroamental
health and solid· waste management to implement the Z'Bel!'g-Kapiloff
Solid Waste control Act of 1976· and the regulations and ordinances
that have been and will be adopted pursuant thereto; and
WHEREAS, the enforcement agency designated by the City of
Palo Alto has been given sufficient p~sonnel and an adequate budget
to carry out the enforcement program specified by law;
NOW, THEREFORE, the Council of the City of Palo Alto does·
RESOLy:E··.as follows·: ·
SECTION ·l. The Council of the City of Palo Alto hereby
designates the City Manager as the enforcement agency for the City
of Palo Alto pursuant to subsection (a)(3) of Section 66796 of
the Government Code.
SECTIOB 2. The Council of the City of Palo Alto hereby finds
that the enactment of this resolution is not a "project" within
the meaning of that term as defined in Section 11.04.130 of the
Palo Alto Municipal Code and, therefore, no environmental assessment
is necessary.
