USOLUTION OP THE COUBCIL OF THE CITY OF PALO ALTO
DESIGNATING THE CITY COUNCIL AS THE HEARING PANEL
UND!ll THE SOLlD WASTE CONTROL ACT or 19.76
WHEREAS, the Palo Alto City Council is required by Government
Cade Section 66796.58 of. the Z'berg-Kapiloff .Solid Waste Control ·
Act of 1976 to designate a hearing panel by appointing :!.tself or
by appointing an inaependent hearlng panel; and
WHEREAS, eaid hearing panel aervea as an appeal board to
hear all grievances and appeals from enforcement and perDlit actions
taken by the City enforcement agency; and
WHEREAS; Palo Alto City Cbal:ter Article III, Section 22
authorizes the City Council to appoint only advisory boards and
commissions; and ·
WHEREAS, .·the hear'i.ng ·panel .under tbe Solid Waste Control Act
of 1976 is designed to'functio:i "in a non-advisory manner;
.. NOW, THEREFORE, the Coiincil of the City of Palo Alto. does
RESOLVE as follows:
SECTION 1. The Palo Alto City Council hereby is designated as
· the hearing panel under Government Code Section 66796.58 of the
Solid Waste Control Act of 1976.
SECTION 2. The Council of the City of Palo Alto hereby finds
that the enactment of this resolution is not a "project" within the
meaning of that term as defined in Section 11.04.130 of the Palo ·
Alto Municipal Code and, therefore., no environmental assessment is
necessary. ·
