RESOLUTIOH OF THE cOUHCIL OF THE CITY OF PALO AL'l'O
APPROVING MISCELLANEOUS DIVISION OF LAND FOR PROP~
ER'tY GENERALLY KNOWN AS 300 SAN ANTONIO ROAD AND
GRANTING EXCEPTIONS SUBJEcT" TO CONDITIONS
-. WHEREAS, approximately 3.80+ acres of property zoned L-M-S and
located at 300 San Antonio Road In the City of Palo Alto, hereinafter
referred to as the "subject property" is proposed to be divided into
two lots; and,
WHEREAS,· lots in an L-M-S zone are required by Sections 18.60.060
and 18.60.070 of the Palo Alto Municipal Code to .have an area of one
acre and a width of 100 feet and one of the proposed lots fails to meet
said-minimum requirements and requires an exception from said require-ments1-. .
NOW, THEREFORE, the Council of the CitY of_ Paio Alto does ·;RESOLVE as follows: -
SECTION _l. '!'he City Council finds th~t there are special: condi-·
tions affecting the _lots, including-the extension of Nita Avenue . .
through one of the parcels, that the exceptions granted herein are ne~
essary for the preservation and enjoytrie_nt of a substantial property
right of the petitioner, and that the exceptions qranted herein_will
not be detrimental to the public welfare and injurious to other prop-
erty in the territory iii which this _property is-. situated.
SECTION 2:. The CitY com(µ.l. her~ appraves the MiscellMeous
Division of Land for the subjeet property, as shown on the map.attached
hereto as· Exhi!:>it •A" and incOrporatea herein; by· this reference, and ·
qrants · the exceptions to the one acre minimuin 1ot size_ and 100 feet
minimum lot width re<:iuirements., 8fl provided by Cbapt.er ·21.68 of the·
Palo .Alto Municipal Code, Subject t~ the following eonditions:

days of Ci cy Council approval,· s~ vider·· shall construct .

INTRODUCED ANO PASSED: .June 20, 1977
Came to Council fran the Planning C01T111ission with a reconmendation to
approve the preliminary parcel map. According to Lynnie Melena, approval
~ of a preliminary parcel map requires that Council pass a resolution.
\~ The resolution, for some reason, was not prepared prior to the June 20
meeting. However, it was adopted at the meeting. The. Attorney's Office
' has been contacted several times about drawing up this resolution with
no results to date.
SP feels we have done all we can, and all we can do now is attach this
note to the file explaining why the resolution fs missing if anyone
should ever ask for it.
