RESOLUTION NO. J40§
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE PRELIMINARY PARCEL MAP 'OR PROPERTY -
LOCATED A'f. 4180 OLD ADOBE ROAD, AND GRANTING.
EXCEPTIONS ~UB.JECT TO CONDITIONS
WHEREAS, 2.14 acres of property zoned R~E (Residential
Es~ate) located at 4180 Old Adobe Road, her~inafter referred
to as the "subject'property" is proposed to be divided into
two (2) parcels; and
WHEREAS, Parcel B is required by Section 21.32.050 of the
Palo Alto Municipal Code to have frontage upon a public street
-or to have access to a public street over a piece of land at
_ ... lease fifteen (15) feet wide under the same ownership __ .s.a
Parcel B, and_ not an easement, and fails to have S•!:.h --access; and ·. ·
WBEREAs, Parcel Bis required-by-Se~tion 2i.32.0SO of the
Palo Alto Municipal Code.to exceed the area of Parcel A by
twenty· percent (201), and fails to have sµch_~rea.
NOW. THEREFORE, the Council of the· City of Palo Alt9 does
RESOLVE as follows:
SECTION l, The City Council finds that there are special
conditlona_af!ecting Parcel B due to the existence of' an access
easement Which would serve Parcels A and B which would result
in ~ parallel roads and.that the use of property for porti~
of Old AdObe Road reduced available land resulting in Parcel B
being of lesser area Chan required; that the excep~;.ons p-anted
herein are, ~cesaary for_ the preservation -and enjoyment of a '··.
substantial property.right of the petitioueri and that the
exceptions will not be detrimental to tbe public welfare or
injurioua to other property in the territory 1n which this pro-
-p-erty is situated.
SECTION 2. The City Council hereby approves the preliminary
parcel-map for the subject property, as shown on the map attached
hereto and incorporated herein by reference; and grants the , -·
exceptions to the requirements of Section 21.32.050 of the Palo
Alto Municipal Codet subject to the following conditions:
