RESOLUTION NO. 5398
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING THE VACATION OF A CERTAIN PUBLIC UTILITIES
EASEMENT IN LOT 17, BLOCK 117, C~SCENT PARK SUBDIVISION
~
WHEREAS, it is the intention of the Council of the City of
Palo Alto to vacate a certain public utilities ea,ement in the
City of Palo Alto, County of Santa Clara, State ol California,
as described in EXHIBIT A attached hereto and sholin·on a map
marked EXllIBIT B attached hereto and by reference made a part
hereof; and ·
iV'liEREAS, the Council of the City of Palo Alto does hereby
find that the aforesaid easement has not been used for the purpose
for which it was dedicated or acquired for five consecutive years
next preceding the date of this resol~tion: and
WhEREAS, from all the evidence b...bmitted to t.~e Council of
the City of Palo Alto it is found that said easement as described
herein is unnecessary for present or prospective public utilities
purposes* -
NOW, THEREFORE, the:. Council of the City of Palo Alto does
RESOLVE as follows:
SECTION l. That pursuant to the provisions of Section.50443
of the Govermaent Code.of the State of California, the Council
of the City of Palo Alto does hereby order that said easement as
described herein be, and hereby is, vacated.
SEC'r'~ON 2. The Council hereby finds that this project
qualities lor a categorical exemption from the requirements for ;,
an environmental assessment.
SECTION 3. The City Clerk shall cause a certified copy of
this resolution to be recorded in the off ice of the County
Recorder of Santa Clara County.

Park Subdivision, as granted in the Deed executed by Palo Alto
Land company to the City of Palo Alto, recorded January 5, 1934,
in Book 667, page 516, Official Records of Santa Clara C9unty.
