RESOLUTION NO. 5359
RESOLUTION·OF THE COUNCIL OF THE CITY-OF PALO ALTO
PROVIDIM FOR THE WITHDRAWAL OF CERTAIN UNINHABITED
TERRITORY DESIGNA"TED AS GARDEN TERRACE NO. 5 FROM
-THE FREMONT FIRE DISTRICT
WHEREAS, Section 13952 of the California Health and
Saf~ty Code authorizes the withdrawal of territory from a
fire district when such territory is annexed to a city; and
WHEREAS, the Santa Clara County Local Agency Formation
Conmission by its Resolution No. 75-123, passed and adopted
on Ncvember 5, 1975, directed the City ot Palo Alto to withdraw
the territory designated as "Garden Terrace No. 511 from t:he
Fremont Fire District within one year after the annexation of
said territory is complete; and
WHEREAS, on April 14, 1976, the City Clerk of the City
of Palo Alto recorded with the Recorder of the County of Santa
Clara an affidavit of completion of sai.d annexation, together
with required documents attached, as required by Government
Code Section 34080; ·
NOW, THEREFORE, the Council of theCity of Palo Alto does
RESOLVE-as follows:
SECTION 1. That certain unit1habited territory known as
Garden Terrace No. 5, described in EXHIBIT A attached hereto
and incorporated by reference herein ~s though fu1ly set fort~,
ann as shown on the map attached hereto as EXHIBIT B and
incorporated by reference herein as though fully set forth,
hereby is withdrawn from the Fremont Fire District effective
on March 7, 1977.
SZCTION 2. The City Clerk is directed to file a certified
copy of this resolution with the governing body of the Fremont
Fire District, the Board of Supervisors of the County of Santa
Clara, and the County Assessor of the County of Santa Clara.
SECTION 3. The Council of the City of Palo Alto hereby
fi..11.ds that this project will have no significant adverse
environmental impact.

PROPERTY'DESCRIPTION:
Beginning at the northerly corner of the City 1 imi ts of Palo Al to as said
corner was established by" annexation of Garden Terrace No. 3 to the City of
Palo Alto on April 25, 1960, Ordinance No. 1935~ said corner also being a
point on the northwesterly line of Monroe Drive (50 feet wide) and also being
the most easterly corner of Lot 11, as said lot and Drive are shown on that
certain map entitled "Tract No. 483 Monroe subdivision .. which map was recorded
on March 15, 1948 in S"ok 15 of Maps at pages 50 and 51, Santa Clara County,
~aliforniu; thence along the northwesterly line of Monroe Drive which line
coincides with the northwesterly 1 ine of said annexation, th~ following bearings· · .
and distances: S. 38°30' W. 266.66 feet to the most southerly col'ner of Lot
8 of said.Tract No. 483; thence S.51°30' E. s.oo feet; thence s.38°301 w.
25.87 feet; thence along a tangent curve to the left, having a radius of
-170.00 feett through a central angle of 45°00 1 0011 for at: arc df stance of
133.52 feet; thence S· 83°30' H. 5.00 feet; thence s. 6°30' E. 137.50 feet to
the southwesteriy corner of ·sa;d Annexa'tion, said corner also being the most
easterly corner of Lot 5, of said Tract No. 483, and al so a point on the City
limits line of Palo Alto as said line \'las.established by annexation of Garden
Terrace No. 1 A on August 27, 1959, Ordinance No. 1878; thence along said last
named City 1 imits l foe the follnwing bearings and di stances: s. 87°14' l 611 H. -
129.36 feet, N. 6°30'W. -72.50 feet, and s. 87°14'16'' H. -119.85 feet to a '9
. point on the easterly City limits line of the City.of Palo Alto as said line
was established by annexation of El Camino Real annexation No. 1 to the City
of P~~o Alto on December 12, 1954, Ordinance No. 1578; said line also being
the centerline of Adobe Creek; thence northeasterly a(ong said last named
line to the most northerly. comer of said Lot ll; thence S.51°30' E. along
the northeasterly line of said Lot 11, 303.12. feet to "the point of beginning,
contain!ng 3.025 acres, more or less, and being a portion of said Tract 483
and a. portion of the Rancho Rincon de San Frandsquito.
