A RESOLUTION OF INTENTION TO FORM MAINTENANCE DISTRICT
CALIFORNIA AVENUE AREA OFFSTREET PARKING
MAINTENANCE DISTRICT

RESOLVED, by the Cou11cil of the City of Palo Alto, California~
as follO"ws:
1. In the opinion of this Council, th~ public interest and
convenience require, and it is the· intention of said Council to order
the formation of an offstreet parking maintenance district in a por-
tion of said City to be designated "California Avenue Area Offstreet ·.
Parking Maintenance District", by which name it shall hereafter be
refe=red to in all subsequent proceedings, including proceedings for
the levy and collection of assessments.
2. Said offstreat parking maintenance district, and the
boundaries thereof, benefited and to be assessed for the maintenance
and operation of the improvements hereinafter referred to, are situate
in the Count~ of Santa Clara, State of California, and are particu-
larly described in Exhibit "A" h:-.reto attached and by reference incor-
porated herein.
3. It is ordered that the expenses of maintaining and operating
all offstreet parking places of the City within said proposed dis-
trict, including all walkway6, crosswalks, fences, safety zones, plat-
forms, steps, stairways, fountains, signs, park and parkways, ·retain-
ing walls, and embankments, and all structures o~ other facilities
necessary for park and parkway eurposes, drai=iage facilities, poles,
posts, wires, pipes, conduits, tunnels, lamps and other suitable or
necessary appliances for the purpose of lighting ctreets, places or
public ways; water mains and sprinkler ayateQS, and ornamental plan-t;ilng,
including lawns, shrubs and trees; all as now existing or hereafter to
be constructed in or for said maintenance diatri~t, and of benefit to

including the cost of necessary repairs, replacements, fuel, power,
el.ectric current, care, supervision, and-any and all other items
necessary for the prcper maintenance and operation thereof, shall be
assessed upon the real property lying within said of £street parking
maintenance district above described, which district said Cow1cil
hereby preliminariiy determines will be the district benefited by the
maintenance-and operation of said improvements.
4. Said annual offstreet parking maintenance assessments shall
be levied against all taxable real property within the boundaries of
said district in accordance with the ordinance formula set forth in
Section 13.16.150 (Bond Plan G-Vehicle Offstreet Parking Bonds) of
Chapter 13.16 of Title 13 of the Palo Alto Municipal Code; said
assessments shall be levied at a rate per adjusted square footage of
floor areas of nonresidential structures (o~her than those completely
vacant on the lien date) sufficient to pay all costs, as set forth in
Section 4, of maintenance of said improvements as determined by the
annual budget for said district to be approved by this Council; pro-
vided, that such ~ .te of assessment shall in no event exceed
$ .06 per adjusted square foot. Said special assessmen_t tax
shall be levied and collected at the same time and in the same manner.

5. Notice is hereby given that Monday, the 14th day of Mar.ch,
1977, at the hour of 7:30 p.m. at the r~gular meeting place of this
Council, at the Civic Center, 250 Hamilton Avenue, Palo Alto,
California, la hereby fixed as the time and place when and where
any and all persons interested having objectioas thereto may make
objecticn to the formation of said maintenance district or the ex-
tent thereof, or both, may appear before said Council and sh("'-.. cause
why the formation of said proposed ma_intenance district should not
be carried out in accordance with this Resolution of Intention.
6. The Clerk of said City is hereby directed to cause to be

mailed, postage prepaid, notices of the adoption of this Resolution of
Intention to all persons owning real property proposed to be assessed
whose names and addr~sses appear on the last equalized assessment· ro11
prior thereto, at the address~s a~ shown upon the roll or as kn~wn
to said Clerk, and of the transferees of any such persons as their
names and addresses appear on the records in the Assessor's office
which will be used to prepare the next ensuing roll, and to :lll per.:.··
sons, including those whose propercy is assessed by the State, under
Section 19 of Article XIII of the California Con~titution, who filed
with the Assessor for the current fiscal year, statements of name and
address and a request that notices be mailed to them at said address
or whose address is shown upon the last Board roLl transmitted to the
Count; Auditor, said mailing to be completed not later than ten (10)
days prior to the date herein fixed for hearing.

conspicuo~ly post~d along the lines of the proposed maintenanc( dis-
trict, and on all open streets within said district, at not more than
300 feet in distance apart, and not less than three in all, notices
of the passage of this Resolution, which notices shall be entitled,
"Notice of Proposed Formation of California Avenue Area Off street
Parking Maintenance District", in letters not less than one inch in
height; and shall in legible characters, state the fact and date of
passage of the Resolution of Intention and the time and place set for
the hearing of protests, briefly describe the improvements and facil-
ities proposed to be maintained and operated, the formula to be es-
tablished for the levy of the assessment to pay the expenses of said
maintenance and operation, and refer to the Resolution of Intention
for furthe~ particulara. Said poeting shall be ~ully completed at
leadt ten (10) days prior to the date fixed for said hearing.
8. The Clerk of said City shall cause a notice similar in form
to the notice to be posted, to be published ~nee a w~ek for two suc-
cessive weeks, with at least five days intervening between the respec-

Palo Alto Times, a newspaper of general circulation published in the
City of Palo Alto, the first publication of which shall be at least
ten (10) days prior to the date fixed for said hearing.
9. Said proceedings are being taken and said district is pro-
posed to be formed pursuant to Section 13.12.0SO(c) and the provisions
of Chapter 13.16 of the Palo Alto Municipal Code.
