HomeMy WebLinkAboutRESO 5351• • • ORIGH\JAL RESCt.UTlON NO. 5351 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING TRE PRELlMlNARY PARCEL MAP FOR PROPERTY LOCATED ON UPPER PAGE MILL ROAD IN PALO ALTO FOOT- HILLS, ASSF$SOR·' S PARCEL NUMBER 351-5· 31, AND GRANTING EXCEPTIONS ~~BJECT TO CONDITIONS WHEREAS, 95.5 acres of property zoned 0-S anj located on upper Page Mill Road in the Palo Alto Foothills, being a portion of lots 1, 2 and 3, and the West !/2 of the Northeast 1/4 of 3ection 10, Towi,ship 7 South, Range 3 West, Mount Diablo Base and Meridian, identified as Assessor Parcel No. 351-5-31, here- inafter referred to as ;:he "subject property" is proposed to be divided into four (4) parcels; and WHEREAS, lot 2 is required by Section 21.32.050 of the Palo Alto Municipal Code to have frontage upon a street dedicated as a public street or be a rear lot with access not over an ease- ment but over land under the same ownership as that of the rear lot and faile tc have this frontage or acc2ss, requiring an ~xception from said requirements; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that there are special conditions affecting lot 2 dv.e to the terrain which dictateB that the land be divided into certain parcel co11figurations to obtain U3able building sites; that retaining the existing access road as a aha~ed private easement to lot 2 would minimize the amount of cut, fill and grading required to provide access;-that the exceptions granted herein are necessary for the preservation and enjoyment of a substantial p~operty right of the petitionbr; and that the exceptions granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this property is si~uated. SECTIOI 2. The City Council hereby approves the pr~liminary parcel mapor the subject property, as shown on the map attached hereto and incorpora~ed herein by reference, and grants the exceptions to the requirements of Section 21.32.050 of the Palo Alto Municipal Code, subject to the following conditions: 1. Prior to City approval of the parcel map, the subdivider shall exec1Jte an agreement, subject to approval by the City Attorney, for continual maintenance of a:l priv&te access roads contained in the subdivision to the standards required by the Palo Alto Fire Depart- ment. Such agreement shall be recorded and shall run with the land. 2. Each parcel in the subdivision shall be required to have an adequate on-site domestic anJ emergency water supply system designed to meet all applicable City codes and design specifications. To this end, the subdivider shall be responsible for installing a 6" public water line across lot 3 to a point on the 25 foot wide privace ingresa-&:gress easement approximately equid1.stant between ,-_.' the existing house on lot 2 and the proposed building site on lot 1. A 20 foot wide public utility ease- ment to accommodate this water line shall be granted to the City on the parcel map. Furthermore, the sub- divider shall be responsible for installing three f irr. hydrants: (1) One hydrant shall be placed on the east side of Page Mill Road, i.rmnedia tely to the right of the private access road which serves lots 1, 2 and 3. (2) A second hydrant shall be placed at the loi·1er end oi the 611 water line where it terminatPS on the private access easement serving lots 1, 2 and 3. (3) A third hy~rant shall be placed on the east side of Page Mill Road adjacePt to the private access road to lot 4. Design of tne water line and placeruent of hydrants is subject to approval by the City. The water line and hydrants shall be installed prior to City approval of the parcel map or an agreement shall be executed and a bond shall be posted by the subdivider, in the amount to be determined by the City, prior to City approval of the parcel map, to ensure completion of these improvements. 3. The subdivider shall install, at his expense, road improvements both within the public right-of-way an<l within the subdivision to provide adequate access for conventional vehicles as well as fire protection apparatus. 'lhe · <2si£n of the road improvements shall be reviewed and must meet with ti1e appro"1al of the City Traffic Engineer and the City Fire Department, prior to City approval of the parcel map. The road improvements shall be installed prior to Ci~y approval of the parcel map, or an agreement shall be executed and a bond shall be · posted by the subdivider, in the amount to be d~tennined by the City, prior to City approval of the parcel map, to ensure completion of road improvements. The sub- divider shall make an irrevocable offer of dedication to the City of Palo Alto of clle existing or proposed roadway within the subdivision, and all improvements thereon, to a widtL of twenty feet {2D'). 4. Sewer service to future houses on lots 1 and 2 will be based on the requirements of the Santa Clara County Envirormental Health Department, as follows: Soil percclation tests shall be requi~ed to determine the adequacy for development of the proposed building sites on parcels l and 2. Prior to conducting the percolation tests, site development plans must be submitted to the County Envi=onmental Health Service~. Any septic tank and drainfield system constructed on these parcels must be in compliance with Chapter 16.10 of the Palo Alto Municipal Code. Sewer Service to future house.s on lots 3 and 4 must be provided by connecting the houses to the Palo Alto City sewer system. 5. The subdivider shall grant a 10 foot wide overhead/ underground public utility easement to be centered on each existing power pole line within the subdivision. These public utility easements shall include the p~wer lin~ serving the Block property (Assessor's Parcel No. 351-5-24) and shall extend approximately 20 feet beyond (northeast of) t:he terminal pole that serves the Block residence. The subdivider shall obtain by separat~ instrument the power line easement on the Block property, prior to City approval of the parcel map or show good faith bonafide att~mp~s to accomplish th~ same. -2 - ._ ____________________________ ...__,.......,~,,··--------------------------------------------.... . . . • • 6. The_ subdivider shall grant a one foot wide non- access strip-~long portions of the Page Mill Road frontage oi the property, to be shown on the parcel tnap in form and deed acceptable to the City Attorney. SECTION 3. The City Council hereby finds that the proposed project will not have a si.gnificant impact on the environment.
