AMENDING SECTION 1501 OF THE MDIT SYSTEM RULES AND

THE CITY OF PALO ALTO AND LOCAL 1319. INTERNATIONAL
ASSOCIATION OF FIRE FIGHTERS AND RESCINDING

The Council of the City of Palo Alto does RESOLVE as fol-
lows:
SECTION l. Section 1501 of Chapter 15 of the Merit
System R"uiea and Regulations is amended to read as follows:

In the case of conflict between this chapter and
any other provision& of the Merit System B.ulea and
Regulations, ·this. chapter will prevail over such other
. provisions as to employees represented by said Local
1319, International A•aociation of Fire Fighters."
SECTION 2.. The chuagea .. provided for in this resolution
shall not Affect any right.established or accrued or any offense
or act coumitted, or any penalty of forfeiture incurred, or any
prosecution, euit, _or proceedi.ng· pending or any judgment rendered
prior to the effective date of this resolution.
SECTION 3, The Council of the City of Palo Alto hereby
finds thit·the ·enactmeut·of this resolution is not a "project"
within the meaning.of.that texm aa defined in Section 11.04.130
of the Palo Alto Municipal Code and, therefore, no environ-
mental aasesammt.t is necessary.
SECTION 4. Resolutions Numbers 5135, adopted Auguat 25,
1975, and $2b3, adopted March 15, 1976, are rescinded.

December 19, 1976 -December 31, 1979
This Menorandum of Understanding between the City of Palo Alto, hereinafter
·referred to as the "City11 , and local 1319,. International Association of Fire
Fighters, hereinafter referred to as the "Union", has been prepared and entered
into in accordance with Title !,,Division 4, Chapter 10, Sections 3500-3510
of the California Government Code and Chapter 12 of the City of Palo Alto Merit
System Rules a:ij Regulations.
It is agreed between the City and the Union that this Memorandum of Understanding
constitutes a complete agreement between the parties on all outstanding issues
fovolving wages, hours and other conditions of emP.loyment. All previous agree-
ments not altered by this Memorandum of Understanding are incorporated herein and ·
made part of thi~.agreement.
ARTICLE I. SALARY PROVISIONS
Section 1. Effecthe beginning December 19, 1976, a salary increase of _5.2%
will be applied to the salary ranges of the following classifications:

Section 2. Effective beginning January l , 1978, a salary increase will
be applied to the salary ranges for the classifications listed in Section 1
as follows:
.. The minimum salary increase will be 4%. If the Bureau of Labor
Statistics Consumer Price Index for the San Francisco/Oakland
area increases more than 4% between September 1976 and September
1977, one-half _of .the percentage increase over 4% will be added
to the mini111J111 percentage salary adjustme_nt (4%) to a maximum total
salary increase of 6.51.

·Section 3. Effective beginning January 14. 1979, a salary increase will
be applied to the salary ranges for the classifications listed in Section 1
as follows:
The minimum salary increase will be 4%. If the Bureau of Labor
Statistics Consumer Price Index for the San Francisco/Oakland
area increases more than 4% between September 1977 and September
1978, one-half of the percentage increase over 4% will be added
to the minimum percentage salary adjustment (4%) to a maxjmum
total salary increase of 6.5%.
J'.RTICLE IJ. CITY CONTRIBUTIONS TO MEDICAL AND DENTAL INSURANCE PREMIUMS
S2ction 1. It is agreed between the parties that, except as otherwise
set forth herein, the City will maintain the present level of benefits
on all City sponsored medical and der.tal programs. In addition, it is
agreed as follows:
(a) City Health Plan or Kaiser Health Plan
The City agrees to pay 100% of the premiums for all: employee
and dependent coverages on behalf of eligible and enrolled
employees and dependents. Health Plan premium increases during
the tenn of this Memorandum will be as~umed by the City.
Effective January l, 1978, the City.Health Plan major medical
maximum will increase to $25,000 for retired eligible Fire
employees under age 65 retiring af~er this date~ At age 65
the maximum.will again revert to $10,000.
(b) Dental Plan
Effective December 19. 1976, the City shall pay all premium payments
or equivalent ~elf-insured program charges on behalf of employees
arid dependents who are eligible and enrolled for coverage under
the existing dental plan. Previously eligible dependents who
were not enrolled for coverage prior to Decembp,r 19,-1976, may
enroll for coverage under the dental plan but must wait six months
after the date of enrollrpent before receiving benefits under the
plan.

ARTICLE III. OVERTIME PREMIUM RATE
Section 1. Shift personnel assigned to overtime relief duty in addition to
their regular 56-hour shift schedule shall receive overtime canpensation
at a rate of one ond one-half times the employee's basic 56-hour rate for
all hours of the relief duty shift. Overtime assigrunents ~or duties other
than minimvm staffing shall receive cNnpensation at a rate of one ancf one-half
times the employee's basic 40-hour rate.
~.RTICLE IV. WORKING OUT OF CLASSIFICATION
Section 1. All out-of-classification assignments resulting from ~acation
coverage will not receive ac~ing pay. All other out-of-classification
assignments assigned by Management where 8 or more hours of the shift are
worked will be paid acting pay from the beginning of the assignment at 7~
above the base regular rate of pay. This provision applies to lower classi-
fications working as Apparatus Operators and Captains. Representation unit
employees working as Battalion Chiefs will follow past practices.
ARTICLE V. PAID TIME OFF -STAFFING AVAILABLE
Section 1. All representation unit fire suppression personnel as of
December 19, 1976, shall be entitled to one shift (24 hours) off with
pay on· a staffing avanable basis to be taken before December 31, 1977.
Hon-shift representation unit personnel will be erttitied tu t-'liiii days off
staffing available under this sectio~.
' . Section 2. ·All representation unit fire suppression personnel as of
January 1, 1978, shall be entitled to one shift (24 hours) off with pay
on a staffing available basis to be taken before December 31, 1978.
Non-shift representation unit personnel will be entitled to two days off
staffing available under this section.
Section 3. All representation unit fire suppression personnel as of
January 1, 1979, sh(lll be entitled to one shift (24 hours) off with pay
on a staffing available basis to be taken before December 31. 1979.
Mon-shift representation unit personnel will be entitled to n.o days off
staffing ava11able-under this section.

Section 4. Time off under this article will be lost if not taken by the
dates indicated. For purposes of this article staffing available means
that no additional overtime expense will be incurred as a resµlt of
taking time off under this article.
ARTICLE VI. IN LIEU OF HOLIDAY PAY
Section 1. For the year beginning January 1, 1977 and ending December 31,
1977, representation unit fire suppressiQn personnel will be paid in
lieu for 11~ holidays.
Section 2. Beginning January t. 1978. representation unit fire supp!'ession
personnel in pay status shall recei_ve 11.5 hours straight time regular pay
per month in lieu of holid~ys to a maximum payment of 138 hours per year.
If employees wish to take time off instead of in lieu pay. time off shall
be at the rate of one-half shift {12 hours) per month on a staffing available
basis. Such time off must be scheduled so that no additional overtime will
· be required to achieve suppression minimum staffing. Time off instead of
in lieu holiday pay may be taken in advance of the month that said in-lieu
hours become p;J.yable up to a maximum of 48 hours. Howevers no in-lieu hours
will be paid until such advanced time off has been liquidated by the in-lieu
hours accrued in subsequent months.
ARTICLE VII •. PAY FOR COURT APPEARANCE
Section 1. Sworn Fire Personnel appearing in·CQUrt for the People shall be

-ARTlCLE VII I. MUUMUM RECALL TO SUPPRESSION SHIFT DUTY
•
Section l. The minimum recall to suppression shift duty s~ll be for
four (4) hours at time and o~e-half.
ARTICLE IX. RECLASSIFICATIONS
SectiGn 1. As resolution of Article II, item one of the ME:mOrandum of
Understanding regarding Stanford Fire Consolidation Services {September 21,
1976) three Fire Fighter positions {one per platoon) assigned to Salvage #6
will be reclassified to Apparatus Operator.
ARTICLE X. RETIREMENT SYSTEM CONTRACT AMENDMENTS
Section 1. It is the intent of the City and the Union that in the third
year of this agreement (1979) the City shall amend its contract with the
Public Employees• Retirement System (PERS) to provide new representation
un1t employees h1red after the date of such amendment with the 2% at 55
s~fety retirement formula and the post~retirement survivor allowance (one-
half continuance) benefit. Existing representation unit employees of
record as vf the date of such amendment will continue with the 2% at 50
_ safety retirement fonnula and in addition receive the post-retirement
survivor allowance (one-h~lf continuance) benefit.
Section 2. In order to implement ~ecti~ l ~bQte, _it ___ will be necessary
to establish enabling legal authority through State legislation or Attorney
General opinion. The Cit1 agrees to aggressively pursue establistlnent of
enabling legal author·ity using the. means it deems appropriate. The Union
.agrees to support the establishment of enabling legal authority. The ~rget
date for establishing such enabling legal authority is September 30, 1978.
If by September 30, 1978 enabling legal authority has not been established, -
all sections of this article will become null and void unless the City and
the Union 111Utually agree otherwise.
Section 3. The effective date of the retirement system amendments described
in Sectfon 1 above wil 1 be no later than July 1, 1979.

ARTICLE XI. MISCELLANEOUS PROVISIONS
Section 1. Manage111ent and Union representatives will work out _mutually
agreeable procedures to provide for an improved linen distribution system
and to provide for station administration of non-food house fund item
purchases.
A~TICLE XII. DURATION
Section 1. This Memorandum of Understanding shall become effeetive December
19. 1976, and will remain in effect untii December 31, 1979t provided that . -the provisions of Article X, Section 2, are_achieved. If the provisions of
Article X become null and void pursuant to Article X, Section 2, the
expiration date of this agreement will b~come September 30, 1978 and all
provisions contained in this Memorandum of Understanding with effective
dates after September 30, 1978 shall become null and void.
ARTICLE XIII. UNION RESPONSIBILITY
Section 1. The Union agrees to present and recorrmend this Memorandum of
Understanding ·"o its membership for ratification as soon as possible. and
to report such ratification to the City.
ARTICLE XIV.. MANAGEMENT RESPONSIBILITY
Section l. Those items of the Memorandum of Understanding not subject to
detennination or review by the City Council will .be implemented by the City
as outlined. Any written administrative directives issued by the Fire
Department implementing specific provisions of the Memorandum will be
revf e\.ted in advance with the Union.
Seetion 2. The City agree$ to present all documents necessary to implement
those items requiring City Council action to the City Council at the eetrliest
practicable time and to reeosmend the adoption thereof.
