A RESOLUTION PROVIDING FOR NOTICE OF INTEN'?ION
TO ADOPT RBSOLUTION OF NECESSI'l'Y INXTIATING
EMINENT DOMAIN PROCEEDINGS

RESOLVED. by the City Council of t.he City of Palo Alto,
California, t.hat
WllBBEAS, it is the intention of this Council t.o adopt a
resolution of necessity initiating eminent domain proceeding$ for
. the ~uisi tion of property for public use;
NOW,. '!BE'UFORE,. IT IS ORDERBD, that
1. The City Clerk is hereby authorized and directed t.o
give notice of the-intention of thi$ Council to adopt a resolu-
tion of necessity pursuant to Article 2 (comaenc-ing with Section
1245.210) 0£ Chapter 4 of Title 7 of Part 3 of the Code of Ci.v.il
Procedure of the State of California ..

City Clerk within fifteen (15) days after the mailing of said
notice, z. hearing will be held on Monday , the 7th day of
February , 1977, at which all persons described in Section 2
who filed such written request may appear and be heard on the
matters referred to in Section 1240.030 and set forth in said
notice.

NOTICE OF INTENTION
TO ADOPT RESOLUTION OF NECESSITY
INITIATING EMINENT DOMAIN PROCEEDINGS

NOTICE IS HEREBY GIVEN pursuant to California Code of
Civil Proeedure 51245.235 that it. is the intent of the Council
of the City of Palo Alto, California, to adopt a resolution of
necessity under Article 2 (commencing with Section 1245.210) of
Chapter 4 of Title 7 of Part 3 of the Code of Civil Procedure
of the State of California and directing the filing of eminent
domain proceedings for the acquisition of certain real property,
hereinafter described, in connection with the university Avenue
Area Offstreet Parking Assessment District, Project No. 75-63,
proceedings for which are being conducted pursuant to Resolution
of Intention No. 5242, adopted August 9, 1976.
NOTICE IS FURTHER GIVEN that Monday the 7th day of February,
1977, at the hour of 7:30 p.m. in the regular meeting place of the
Council of the City of Palo Alto, Council Chanbers, 250 Hamilton
Avenue, Palo Alto, California, are the time and place appointed
and fixed by said Council when and where it will hear all protests
in relation to the adoption of said resolution of necessity and
authorizing the filing of eminent domain proceedings for the
acquisition of property described as follows, to wit:
(i) properties known as 427 and 435 Bryant Street
(the nold Safeway lot•) located between Florence
Street and Bryant Street co:itiguous to and north-
westerly of the alley running from Bryant Street
and Florence Street, and (ii) properties known as
424 and 440 Lytton Avenue located at the northerly
corner of Kipling Street· and Lytton Avenue~ ·
NOTICE IS FURTHER GIVEN that any person .interested may
file a written·request to appear and be heard with the City Clerk
within fifteen (15) days after the mailing of the within notice ·
(mailing address: 25~ BaJPilton Avenue, Palo Alto CA 94301).
Any interested person who files such a timely written request has
the right to appea~ and be heard at the time and place stated
herein on the matters referred to in Section 1240.030 of said
Code of Civil Pr:>cedure, to wit:
(a) Whether the public interest and necessity require
the University Avenue Area Offstreet Parking Assess-
ment District, Project No. 75-631
(b) . Whether said p_roject is planned or located in the
manner that will be most compatible with the greatest
public good ~'"'ld the least private injury; and
(c) Whether the·property sought to be acquired is neces-
sary for said project.
NOTICE IS FURTHER GIVEN that the failure to file such a
written request to appear and be heard within fifteen (15) days
after the mailing of this notice will result in waiver of the
right to appear and be heard.
