RESOLUTION NO. 3902
A RESOLUTION DETERMINING SURPLUS AND
PROVIDING FOR DISPOSITION THEREOF
PORTIONS OF FOOTHILLS ANNEXATION NO. 3
SANITARY TRUNK SEWERS AND WATER SUPPLY SYSTEM
PROJECT NO. 62-8
RESOLVED, by the Council of the City of Palo Alto, Cali-
fornia, that
WHEREAS, all of the work and improvements and acquisitions
provided to be accomplished pursuant to Resolution of Intention
No. 3633, adopted by this Council on May 28, 1963, have been
completed and accomplished as provided in said proceedings;
WHEREAS, the City Controller has prepared and submitted to
this Council a final accounting of funds in said proceedings,
which shows that there is a surplus available for disposition by
order of this Council.
NOW, THEREFORE, IT IS ORDERED as follows:
1. That it is hereby determined that there is a surplus in
the construction fund for said project in the total amount of
$117,14!49.
2. That $21,689 of said total surplus shall be applied as
a credit to the amounts of money contributed by the City in said
proceedings and shall be reimbursed to the City fund from which
said contribution was made.
3. That the remaining balance of said surplus, being
shall be applied as a credit upon the assessment. Where an indi-
vidual assessment has been paid xn cash in full, the portion of
the surplus applicable thereto shall be returned in cash to the
person paying it upon his furnishing satisfactory evidence of such
payment. The determination of the City Treasurer as to the suf-
ficiency of such proof and the person to whom such money is paid

shall be final and conclusive. Where the assessment or any in-
stallment is unpaid,the credit shall be applied upon such assess-
ment or the earliest unpaid installment of principal and interest,
which is hereby determined to be the installment falling due dur-
ing the fiscal year 1966-67.
4. The City Controller and City Treasurer are hereby
authorized and directed to take such action as is necessary to
carry out the provisions of this resolution.

correct copy of a resolution duly passed and adopted by the
Council of the City of Palo Alto, California, at a meeting thereof
held on the llth day of July , 1966, by the following vote
of the members thereof:
