RESOLUTION NO. 4048
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
CONSENTING TO THE ESTABLISHMENT OF A PORTION OF PAGE
MILL ROAD AS A COUNTY HIGHWAY
WHEREAS, on March 28, 1961, the electorate of the County
of Santa Clara approved a $70,000,000.00 County bond issue to
provide funds for the construction of a County Expressway
System as generally described in the County of Santa Clara
Expressway Policy Resolution adopted by the Board of Super-
visors of said County on December 27, 1960, and in the resolu-
tion of the Board of Supervisors of said County adopted
January 9, 1961; and
WHEREAS, one of the projects is Oregon -Page Mill
Expressway between the western terminus of the Oregon Express-
way and Foothill Expressway and lying within the incorporated
limits of the City of Palo Alto; and
WHEREAS, the City of Palo Alto has requested the Board
of Supervisors to add the reconstruction of Page Mill Road
from El Camino Real to Foothill Expressway to Phase I of the
County Expressway Program; and
WHEREAS, the Santa Clara Coui.y Transportation Policy
Committee has recommended approval of the requeet of Palo Alto
subject to an at -grade improvement and subject to relinquish-
ment of Page Mill Road from the western terminus of the Oregon
Expressway to Foothill Expressway; and
WHEREAS, the City of Palo Alto recognizes the importance
of providing for the rational movement of traffic on a system
of County -wide Expressways.
NOW, THEREFORE, the Council of the City of Palo Alto
does RESOLVE as follows:
SECTION 1. That pursuant to the provisions of Article V
(commencing with Section 1720) of Chapter 9, Division 2, of

the Streets and Highways Code of the State of California, the
governing body of the City of Palo Alto does hereby consent to
the establishment of Page Mill Road between the western terminus
of the Oregon Expressway and the Foothill Expressway as a county
highway.
SECTION 2. The project limits of said county highway as
herein declared shall be substantially as shown on Exhibit "A"
attached hereto and made a part hereof.
SECTION 3. Said street shall be constructed and main-
tained as a county highway substantially in accordance with
said Exhibit "A" and said project shall be financed out of the
County Bond Issue of 1961.
SECTION 4. The installation, maintenance, construction
and nature of lighting along said street, or any modification
thereof, shall be subject to the approval of the City Council.
SECTION 5. The County shall not consent to the conversion
of said street to a state highway or state freeway, nor shall
any intersecting or abutting city street, the closing of which
is not provided for in said plan, be closed either directly or
indirectly, nor shall the roadways as constructed be widened,
unless temporarily necessary during construction operations,
except pursuant to an agreement between the City Council and
the Board of Supervisors.
SECTION 6. The police power of the City with reference
to said street, particularly as to the control of the speed
and weight of vehicles thereon, shall not be limited except
that no ordinance of the City relating to the stopping, stand-
ing or parking of a vehicle shall become effective as to said
highway without prior submission to and approval by the Board
of Supervisors nor shall the City erect or maintain any stop
sign, semaphore or other traffic control signaling device in
such manner as to require the traffic on said highway to stop

before entering or crossing an intersecting street or any
railroad grade crossing without permission of the Board of
Supervisors.
SECTION 7. City agrees to continue to maintain at City's
expense those portions of Page Mill Road shown on Exhibit "A"
and located within the City of Palo Alto until the date County
commences construction of the project.
SECTION 8. This consent shall not become effective until
the Board of Supervisors adopts a resolution establishing Page
Mill Road as a County Highway and agreeing to the improvement
indicated here.
SECTION 9. The City Clerk shall file a certified copy
of this resolution with the Board of Supervisors of the County
of Santa Clara.
