HomeMy WebLinkAboutRESO 4030WJML:KIJ:mf RESOLUTION NO. 4030 • 9/5/67 25C ORIGINAL A RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY OF SAID CITYREQUIRE, FOR PUBLIC USE, CERTAIN LAND LOCATED IN THE CITY OF PALO ALTO, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA, FOR THE CALIFORNIA AVENUE AREA PARKING PROJECT NO. 65-9 RESOLVED, by the Council of the City of Palo Alto, California, as follows: Section 1. That the Council of the City of Palo Alto has found and determined, and hereby does find, determine and declare, that the public interest and necessity require the acquisition, construction and completion by the City of Palo Alto of the offstreet motor vehicle parking facilities described is Resolution of Intention No. 3950, adopted by the Council of this City on January 3, 1967, and the work auxiliary thereto, in, over, across and upon the parcels of land more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof, within said City, and that said pro- perty described herein is necessary therefor. Section 2. That the taking of said property in fee is necessary. Section 3. That said proposed acquisitions and improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situated within the City of Palo Alto, County of Santa Clara, State of California. Section 4. That the Council of the City of Palo Alto hereby declares its•intention to acquire the estates and interests herein - above more particularly designated in and to the parcels of land more particularly described in said Exhibit "A" under eminent domain pro- ceedings; and the City Attorney of the City of Palo Alto and the law firm of Wilson, Jones, Morton & Lynch, employed for that purpose, are hereby directed to institute and conduct to conclusion an action in eminent domain for the acquisition of said property and to take such action as is necessary therein, and said law firm of t•1ilson, Jones, Morton & Lynch shall be paid a reasonable fee therefor. Section 5. The City Manager is hereby authorized and directed as an alternative to trial of any action in eminent domain initiated hereunder to purchase for such reasonable sums as he may deem appro- priate the several parcels of land aforesaid and to cause to be drafted, executed and delivered on behalf of the city all documents, either to be used within or without the condemnation proceeding aforesaid, necessary or convenient to accomplish this purpose. Section 6. The City Manager is further authorized to spend from general funds of the City heretofore appropriated for such purposes and from the proceeds of assessments and sale of assessment bonds in said proceedings such monies as are necessary and in his opinion may con- stitute the fair market value of each of said parcels based upon appraisals of duly qualified and competent real estate appraisers. Section 7. The City Clerk shall certify to the adoption of this resolution by a vote of two-thirds of all of the members of the City Council. I hereby certify that the whole number of members of the Council of the City of Palo Alto is eleven and that the foregoing resolution was adopted by a vote of more than two-thirds of all of the members of said Council at its meeting held on the llth day of September 1967, by the following vote: AYES: Arnold, Beahrs, Berwald, Clark, Cooley, Dias, Gallagher, F earson,Spaeth, Wheatley NOES: None ABSENT: Comstock Signed and approved this APPROVED AS TO FORM: ay y er 1967. • • EXHIBIT "A" PROJECT NO. 65-9 PROPERTY TO BE ACQUIRED PARCEL 1 Owner: Joseph and Arlette Chevalier Assessor's Parcel No.: 2-70-47 Beginning at the most easterly corner of Lot 33, as said lot is shown upon the map of "Mayfield, surveyed by W.
