RESOLUTION NO. 4029
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND
NECESSITY OF SAID CITY REQUIRE, FOR PUBLIC USE FOR
.PUBLIC BUILDINGS AND PUBLIC GROUNDS, CERTAIN LAND
-LOCATED IN THE CITY OF PALO ALTO, COUNTY OF SANTA
CLARA, STATE OF CALIFORNIA
The Council of the City of Palo Alto does RESOLVE as
follows:
SECTION 1. That the Council of the City of Palo Alto
has found and determined, and hereby does find, determine and
declare, that the public interest and necessity require the
acquisition by the City of Palo Alto of the real property des-
cribed in Section 2 hereof for public buildings and public
grounds purposes.
SECTION 2. That the taking in fee simple of the property
described in EXHIBIT A attached hereto and delineated on the
map marked EXHIBIT B attached hereto and by reference made a
part hereof, situated in the City of Palo Alto, County of
Santa Clara, State of California, is necessary for such purpose.
SECTION 3. That said proposed acquisition is planned and
located in a manner which will be most compatible with the
greatest public good and the least private injury, and all of
such acquisition is located within the territorial limits of
the City of Palo Alto.
SECTION 4. That the Council of the City of Palo Alto
hereby declares its intention to acquire title in fee simple
in said land described in EXHIBIT A under eminent domain pro-
ceedings, and the City Attorney of the City of Palo Alto and
the law firm of Messrs. Wilson, Jones, Morton & Lynch,

employed for.. that purpose, are hereby directed to institute
and conduct to conclusion an action in eminent domain for the
acquisition of said property in fee simple, and to take such
action as is necessary therein.
SECTION 5. The City Manager is hereby authorized and
directed, as an alternative to trial of any action in eminent
domain initiated hereunder, to purchase for such reasonable
sum as he may deem appropriate, an option on the real property
described in said EXHIBIT A, said option to grant to the City
the exclusive right and option to purchase said parcels.
SECTION 6. The City Manager is further authorized to spend
from general funds of the City heretofore appropriated for such
purposes such monies as are necessary and as in his opinion may
constitute the fair market value of said parcels based upon
appraisals of duly qualified and competent real estate appraisers.
SECTION 7. The City Clerk shall certify to the adoption
of this resolution by a vote of two-thirds of all of the members
of the City Council.

BEGINNING at the point of intersection of the Southeasterly
line of Forest Avenue (60 feet wide) with the Southwesterly line
of Bryant Street (60 feet wide); running thence Southeasterly along
said line of Bryant Street 62.50 feet; thence at a right angle South-
westerly 100.00 feet; thence at a right angle Northwesterly 62.50
feet to a point on said Southeasterly line of Forest Avenue; thence
Northeasterly, along said Southeasterly Line, 100.00 feet to the
point of beginning, being portions of Lots 52, 53, 54, and 55 of
Block 10 as laid down on the Map entitled "Map of Lots 3 and 4 in
Block 10 University Park" of record in the Office of the County
Recorder of said County of Santa Clara, in Book "E" of Maps, at
page 103.

BEGINNING at the point of intersection of the Southeasterly
line of Forest Avenue (60 feet wide) with the Southwesterly line of
Bryant Street (60 feet wide); running thence Southeasterly along
said line of Bryant Street 62.50 feet to the True Point of Beginning;
thence continuing Southeasterly along said line of Bryant Street
37.50 feet; thence at a right angle Southwesterly 100.00 feet; thence
at a right angle Northwesterly 37.50 feet; thence at a right angle
Northeasterly 100.00 feet to the True Point of Beginning, being
portions of Lots 52, 53, 54, and 55 of Block 10 as laid down on
the Map entitled "Map of Lots 3 and 4 in Block 10 University Park"
of record in the Office of the County Recorder of said County of
Santa Clara, in Book "E" of Maps, at page 103.

Bryant Street (60 feet wide); running thence Southeasterly along said
line of Bryant Street 100.00 feet to the True Point of Beginning;
thence continuing Southeasterly along said line of Bryant Street 37.50
feet; thence at a right angle Southwesterly 112.50 feet; thence at a
right angle Northwesterly 37.50 feet; thence at a right angle North-
easterly 112.50 feet to the True Point of Beginning, being all of Lot
51 and a portion of Lot 50 of Block 10 as laid down on the Map en-
titled "Map of Lots 3 and 4 in Block 10 University Park" of record
in the Office of the County Recorder of said County of Santa Clara,
in Book "E" of Maps, at page 103.
Commonly known as 704, 712, and 718 Bryant Street, Palo
Alto, California (City Assessor's Parcel Nos. 2-40-1, 2-40-2 and
2-40-3).
